      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have today received this:

 

Unless payment is made on your loan by 2 August 2013 it may be sold to a third party collection agency.

QuickQuid will accept a re-payment plan over n/a months. Based on your outstanding balance of n/a this would be a monthly payment of n/a. Please contact our Final Resolution Department between 08:00 and 21:00 Mon - Fri at 0800 016 3114 to accept this offer or to learn about other options available. It is important to provide dates of payment when replying to this e-mail as the arrangement is incomplete without dates of payment.

Once a payment plan is in place, collections activities will stop as long as payments are made on time. The only forms of payment accepted for this offer are Debit Card or Direct Debit Mandate. If your account information has changed please inform our agents so they can update your information.

 

QuickQuid Final Resolution

 

I have never had a loan with quick quid. I logged intot he site using the details on the email and it sys no ative loans. Ive checked thee bank an nothing has gone in or out that shouldn't have. they are ignoring my emails.

Yep like i said a few people have had emails today from qq, bet oft is gonna be inundated with complaints

 

Very doubtful. Hardly any complaints are ever made to them because the type of person who uses PDL's has very little knowledge of the regulators and how to complain. Most PDL's know this very well, which is why you see so many threats and excessive charges.

ICO doesnt deal with spam. They just deal with companies misuing information.

And QQ was misusing information they were for the most part not legally allowed to use according to the EU Directive on Privacy and Electronic Communications

 

I received £100 compensation from BT for spamming me thanks to a complaint I laid with the ICO regarding their spamming emails.

Please, please make a complaint to the OFT and the Information Commissioner.

 

The OFT are investigating the PayDay Loan companies at the moment - the more complaints they receive the better.

 

If you have never had a loan with QQ or any other PDL as some people are advising - then how have they come into possession of your Email address and Name. This is something you really need to know - who is providing personal details to these dreadful companies.

Complaint to oft and fos. You didnt take out a loan but they still called you a customer

Ive basically said I've emailed a complaint, thus far it's basically been ignored. It's for quick quid to pass onto the relevant department not me. Am I correct in doing so?!

Let them do what they want. After 8 weeks you can bypass them and take it higher.

If you are not a customer of theirs then they have no right to your data in the first place - so how can they say they are processing it correctly ? This is bizarre.

 

If you have a complaint in with the ICO and FOS, then you should update the complaint with this latest nonsense.
