I have a Mint credit card that was defaulted by RBOS, I have successfuly claimed all my charges back, but as the claim has been ongoing since June, I also sent off a CCA request that was signed for on the 25th of September, but is as yet unfulfilled. Wescot Credit have been chasing me and got very cross when I mentioned the CCA, tried to tell me that I couldn't suspend payments and wanted to know why I wanted it :-) I refused to answer her question mearly stating that I was excercising my rights under the act and that their client was in default.

 

My question is this, does my successful claim act as an admission of liability for the debt, could they use this in court? If they were in default on the 7th, when have they committed a criminal offence?
