Hi, hope I am not breaking any rules here but I am a total novice at doing this kind of thing! Where can I post asking for advice on obtaining a court order to force a sale of property please?

I am assuming it is you who wishes to force the sale of a property, yes ?

 

I think you will probably be asked for more information, so if there is anything that you feel able to post up so when people look in, they wont have to keep asking you questions, that would be quite helpful .

Thanks for getting back to me.

 

It is a jointly owned property (as joint tenants), owned by myself and my ex-partner. There is approximately £30000 of equity in the house. He is refusing to buy me out, basically saying that, as I moved out 4 years ago, I 'deserve' nothing apart from £2000. I know this is not legal and have suggested ways to avoid a court order to no avail. I am pretty certain the court order is the only way forward but am very worried about the legal expenses.

 

Since I first posted, I have spoken to the local court who are sending me a form out. It will cost £175 to file the order. That's okay, but my concern is that he (my former partner) will claim that, as he has been solely paying the mortgage for the last four years (despite me asking him to buy me out), I am not entitled to anything.

 

Is there any other way out of this??!

Are you on the deeds? Are you on the mortgage (even if you did not pay anything)? How long were you living together? Have you sought the advice of a family lawyer? The first 30 mins consultation is usually free and a family lawyer would explain your rights and advise the processes? They can subsequently help you word court orders etc to put towards a judge if this is appropriate.

Successfully claimed back mis-sold PPI (Barclays Bank) 2009-10 (£8500)

Ran a paid-for DMP. Deeply respect those who self-manage a DMP; it is possible to do with the help of fellow CAGGERS

Offered F&F to all my creditors. All closed out including a particularly intransigent and stubborn one - who eventually saw sense after 10 months of nonsense!

Does not condone debt avoidance but violently disagrees with the antics of debt collectors and their behavior towards the ones trying to pay. I am a great believer in what goes around, comes around. Keep up the good fight!
