Hello everyone

 

I am writing this for a friend. He is self employed as a sole trader and last year made a purchase from a supplier on his personal credit card from a supplier. He also has a business credit card with LTSB

 

The products were faulty and he attempted to send them back but the supplier refused so he tried to get a credit from Tesco

 

They have written back saying that they can not help because they do not cover business transactions. He has at no time said they were a business purchase

 

Does he have any rights and if so what should he do next

Thank you dx. So he has a right under the soga to get a refund but I do not know if he is covered by s75 on his personal credit card. The supplier is not playing ball so although he could make a small claim it would be a lot easier if the credit card who pay.

but I WOULD NOT believe what you are being told from ltsb

 

I cant see how they can refuse sec 75.

so long as purchase was for more than £100 on personal card, then card co are jointly liable. complaint to FOS

PLEASE HELP US TO KEEP THIS SITE RUNNING

Thank you . He has a business card with Ltsb but this purchase was made on a personal card which is a Tesco one. I am going to write a formal complaint letter. Would I be right in heading it formal complaint and saying that I am going to escalate it to the fos ..

Do you think that is worth it as he has had a letter saying no it was a business transaction. I think the problem was it was a personal purchase on a personal card but from a wholesaler who invoiced with the business name. Unfortunately that was the name the wholesale account was in

the fact that the business name is on the invoice is of no consequence

 

nothing on the credit card statement says so?
