The difficulty is that paying the claim is in their hands. If they chose to pay it into a bank account that has an overdraft, then what could you really do?

 

If you were to say to the court that they had not paid - then they would just show evidence that they had paid directly into the bank account.

 

If there is a way round it, then hopefully someone with a more legal brain than mine will be able to help - of course, there is a chance that the bank will just send a cheque anyway, since very often one department doesn't tend to always know what another is doing.

True, very true - mind, a lot of my accounts have either been closed or sold on, so I'd hope they couldn't offset in that case.

 

I still think it'd be different if they were actually settling a court judgement (i.e. not settling out of court)

 

Wouldn't mind knowing for definite though :)

In those cases they would have to send a cheque - they have no right ot send a cheque to what is effectively a third party.
