hi i have a threat by safeloans for £510 and now they are threatning me with court for this, i am currently on benefits and cant afford what they want me to pay back, i want to pay this back but at what i can afford i have 4 young kids as well as a partner to try and support, and now i have this hanging over me i have been putting it off trying to avoid it yes its stupid i know, but now i need to sort it and fast as i dont want to go to court, any advice greatly recieved.

Can you pop a post in the payday loans forum. We can help you there. Dont worry about court as they only take people to court if they think they stand a chance at a default judgement or feel they can intimidate the debtor enough that they wont form a defence.

 

Even if it does go to court, its not like you see on the TV. Theres no judge and jury as its not a criminal matter.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi kerry. If you didnt get the court papers and you have proof you moved and didnt get them, you can apply for a set a side, which means that basically the lender would have to start from scratch.

The CCJ was 3 years ago, and I'm not disputing it as I didn't pay back the loan. With everything going on st the time ie redundancy and moving it just got missed. It was only a few weeks ago that it all came to my attention. They only CCJ'd for the original amount plus 1month interest and court fees which wasn't too bad so am paying on a weekly basis. They seem quite willing to negotiate, which is more than can be said for other PDL companies!
