Hi Bankfodder,

 

I am about to send off my demand for the repayment of mortgage arrears fees, and 'payment option fees, at £25 a time, total of £450 + compound interest. I had thought that I should claim only the NRAM 4.79%, but you state that we should claim a higher rate of interest?

 

Would you be kind enough to clarify.

My understanding, and please do correct me if I am wrong, is that my initial claim to NRAM is at their interest rate, 4.79%, but if, and more likely when, they deny it, I will go to court and ask for restitutary damages at a much higher rate + costs, for wasting my time :wink:

If the broker who arranged the mortgage is no longer trading you can still make a claim to the Financial Service Compensation Scheme. If you have other secured loans on the property the only regulated mortgage would be the first charge on the property but you could still claim for unacceptable charges or mis-sold PPI on the other loans.

2nd charge loans would be regulated, but not by the FSA. The OFT under CCA regulations regulate 2nd charge loans and depending on when the loan was taken out. The limits for regulated loans were lifted in 2008.

Leeds Building Society- mortgage PENALTY fees - offer £150 for +£7k claim!!

 

I have been repossessed on two properties with Leeds Building Society.

I sent them letters for both accounts stating unlawful charges from this site.

They replied saying for compensation they will reimburse 150 gbp, then listed the following for both accounts:

They state write to the FSA if not happy, and we all know what happens when you do that, just need to know if there is anything I can do, 150 gbp for 7k in charges does not seem right.

Searching via Google is pretty useless for finding legal judgements. It is quite difficult even for lawyers to research legal cases and they have to learn how to actually do it as part of their legal studies - which indicates it is a complicated process & you need to have access to the specialist law libraries to do it which is why Google is useless.
