Hello,

 

I took a lovely Minicredit loan out back in June,

I was struggling with debt at the time but thought if I could take this loan out I could get myself sorted, but this didn't help at all.

A few days later I sought advice from Consumer Credit Counselling (now StepChange) and they sent me all information to get me on a debt management plan.

 

Minicredit at the time would not accept payments from CCCS, the payments were put on hold to them as they were being very awkward.

 

a few months later OPOS got involved and I had a very abusive call from them,

they said because I took the loan out then a few days later I sought advice from a debt management that it was classed as fraud

and would inform Minicredit to refuse all payments from CCCS and to take legal action.

They would not let me speak and just kept throwing threats at me.

I said that the plan did not start until July 2012, but they did not care and said because I went on a DMP less than 30 days into the loan it was classed as fraud.

 

I'm just trying to get some advice and to see what is the best action to take, I know it was not the best thing I could of done

but at the time I thought I could arrange a better way of paying my debts back.

firstly

 

your problems are mostly from conversing on the phone with OPOS.

 

they will say, like any DCA, ANYTHING to get you to pay!!

 

they'll never ever put that in writing either!

 

first rule.....

 

DCA's are NOT BAILIFFS

 

they have NO SUCH LEGAL POWERS

 

they can wave their willy's about as much as they like

but have NO TEETH

 

STAY off the phone

 

you are under NO legal obl no should you

discuss your debts on the phone.

 

pay mini credit directly by YOUR internet banking site

or give the CCCS the details of MC's one

and pay that way

 

they CANNOT refuse direct internet transfer.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you so much for replying to my thread,

 

I'm so glad I posted on here, the whole thing was getting to me and just wanted to get some reassurance,

 

yep I'm going to stay off the phone from them,

 

I think it's the worst bullying call that I have ever taken,

they just shout down the phone and to be told that I was a fraud really got under my skin!!!!

 

I told them on the phone that I would not take their calls anymore and I would put everything in writing

to be told that I was in denial and didn't want to keep speaking to them,

your damn right I don't with that attitude.

 

Anyway rant over and thank you for your advice
