Hi Guys

 

Hope you can all help me got a few threads going on these forums at the min just trying to sort my finances such a great forum

 

both me and my husband have Wonga debts

my hubbys is 873 and defaulted on 29.12.2011

mine is 559 and defaulted on 5.1.12

 

both are being handled by mackenzie hall do i deal with them or with Wonga?

 

Are there any charges or fees i could get removed any help would be great

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'd be inclined to agree with above... I know usual advice is deal with the original creditor, but in a case where a payday loan has been assigned to a dca I found that I had a lot more luck dealing with a dca rather than the pdl company. They were happy to take a reduced monthly payment and instantly respected my wishes (for my request to deal with the debt in writing only and remove all contact numbers from their system)

 

Saying that... Did Mucky Hall and wonga ever inform you that they were assigning this debt to MH?

 

Just be sure that they have been assigned collection rights before trying to make a payment arrangement.

 

And YES, 100% don't deal with MH on the phone. You need a paper trail.

hi matto

 

i got a loan from payday express on nov 6

 

i payed it off early they said it was payed in full and i got 42 pound rebate on one and 18 pound on the other

 

they sent me a e mail and told me on the phone yesterday

 

sent me a tex saying they were taking 60 pound out of my account

 

i rang them they said it was a mistake that i got a rebate and that they had been trying to contact me

 

i asked why did they not e mail me

 

they said they did nt have to

 

i told them i had just recenty lost my son

 

they said i should have informed them

 

i said this was the last thing on my mind

i said that they would not get anything out of my bank as i could do nothing till monday

 

where i was told extra payments will go on

 

this is so wrong but no one helps

 

these companies are a law to themselves

 

i told them not to ring me as i am under the doctor and this as caused me great distress

I have found the mackenzie hall letters i am going to email them now see if they will work with me that way i cant afford alot a month so i am hoping they dont give me grief i will pop back and let you know if i hear anything

Hi Guys

 

Been dealing with Mackenzie Hall regarding this wonga debt i filled in and emailed back one of thier income and expenditure forms they have emailed back saying they find the following excessive

 

sky 110.00 (i have a 11 year old Autistic son who doesnt go out and has no friends the t.v is one of his favourite things he has it in his room and watches alot of history and discovery stuff)

Phones 129.00 (i have a mobile as does my husband in case our sons school need us also my 16 yr old daughter has one we pay for because i need to contact her and know shes safe)

Clothes 100.00 ( i easily spend this on clothes i have 3 kids at home my middle daughter is 19 but she is on a apprenticeship so we fully support her while she is training)

 

these are my true bills i was honest and they dont agree what should i do?

That is one of the reasons people don't give detailed income and expenditure reports to these bottom feeding DCAs... They have NO right to this information. Only a court can request this information.

 

Have you made them an offer yet?

 

I'd write back and thank them kindly for their concern about your spending habits and tell them that their comment have been noted. Advise them however that your offer of £** per month is all you can afford at the moment and that you'll be happy to review your offer if and when your financial situation improves.

 

Next time they or any other lowlife DCA send you one of their own I&E forms, use it as scrap paper and come here for further advise.

 

Mucky Hall have featured in many posts on these forums in the past. I should imagine IF you told them that due to further financial problems and their lack of assistance in working with you to try and get this debt sorted then your offer will be reduced to £1 pet month!

 

On a further note. Did they buy this debt or are they just collecting on behalf of the original creditor?

Nothing offer them what you can afford you do not legally have to fill in aincome /expenditure form out and thus they cannot do anything about it also goto your local citizens advice bureau and seek some free advise they will negotiatewith the DCA for you.

Hi All

 

Thanks for replies I did offer them 20 per month on both accounts they asked me to fill I'm the form which I did wish I had come back here now I will email then back today with the comments suggested and see what happens should I really threaten them with a £1 per month? Would they not be able to go court and prove I can afford £20 because I stupidly filled thier form in?

I doubt they'd go near a court.

For now, I'd be firm with your £20 per month offer. Maybe even make arrangements to pay it to them whether they accept your offer or not! (I'm sure their standing order details are on their website - if not I've got them somewhere).

DONT pay the DCA...wonga directly via YOUR internet banking site

 

DCA's are NOT bailiffs

they have NO SUCH legal powers

Back for a little update well i emailed Mackenzie Hall back with the comments suggested i told them i noted their comments on my spending habits and i got this responce

 

Unfortunately based on the information provided we are unable to accept your £20.00 payment proposal.

The minimum terms we require are as follows:

 

********* Balance £559.81 minimum monthly payment over 18 months £31.******** account is in the name of ***** ****** and to allow us to discuss this account in detail with you we require the account holder to call or send written authority for you to deal on his behalf.

I offered them 20 on both accounts they want 31.10 just on mine and my husbands is more than mine i dont know what to do any help guys

ignore them

 

they dont OWN the debt

 

they are NOT bailiffs

 

they have NO such LEGAL POWERS

 

deal with wonga.

 

just send your payments by YOUR internet banking site

 

try this:

 

TELL [dont ask] them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

as an example>

I am currently in financial difficulties and not able to meet my normal monthly repayments.

to show my goodwill, i am going to pay £5 for 6 mts.

 

i will update you in 6mts time or before, should my situation change.

could you please as a reciprocal goodwill guesture,

refrain from levying any penalty charges & freeze the interest on my account.?
