This is a ridiculous threat, no CCJ and threatening a warrant it's a breach of OFT guidance and also a breach of the DCAs remit laid down by the DWP.

You need to make a Formal Complaint to DWP Debt Management regarding their agents actions asap.

 

Mean while send the following to the Compliance Manager CC Collect to arive just after Christmas.

 

Ref: as on that stupid letter.

 

 

Dear sir,

 

I refer to your letter dated xx xx xxxx regarding an alleged overpayment of carerers allowance from the DWP, I am staggered to see that you threaten to apply for a warrant of execution regarding this matter, surely you must be aware that no such action is possible until you have obtained a County Cour Judgement and I have failed to comply with a judgement order, your company should also be aware that this letter is a breach of the OFT Guidance.

 

The arbitrary dead line of Sunday 23rd. December 2012 is of course ridiculous and totally meaning less especially in the context of the action threatened.

 

I am making a formal complaint to the DWP debt manangement department and will send them a copy of your letter, a similar complaint will be bade to the debt collection team at the Office of Fair Trading with a comment on the fitness of CCS Collect to hold a Consumer Credit Licence.

 

I will also ask my MP to forward a copy of the letter to Lord David Freud Minister for Welfare Reform at the DWP.

 

I will not consider making any payment until this is resolved and full details of the allged debt are supplied.

 

Recorded Delivery is best, track the date they receive it.

Yes agreed a SAR may get the data on the debt, and you do not need to send the usual statutory fee of £10.00.
