Hi

 

My question is about how long defaults stay on your CRA account. I know a debt is unenforceable after 6 years so would all default notices be removed after 6 years or would each default notice stay for 6 years. If that is the case a record of the debt would be on your account for 12 years.

Sorry that is what I meant. My credit file is updated each month. A DCA cannot provide me with valid CCA and I have not been paying until they do. This has been going on for three years and I have 3 years do missed payments on my credit file.

 

Well done, 3 down and 3 to go. Without a CCA they cannot take you to court, all they can do is ask for the money. Once you have achieved 6 years without making payment or admitting the debt in writing it will be statute barred and you have won.

To add to the advice above, if the accoutn is unenforceable, the creditor should stop chasing you. However, for some reason, a lot of creditors dont. Maybe they think that continued harassment ( a violation of multiple OFT guidelines) will make you pay something to them.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
