Hi I purchased a LG G Watch from Carphone Warehouse online on the 28 th of Sept 2014 and picked it up from a high street store 3 days later. The watch cost £150. The strap has now split and the watch cannot fasten on to my wrist. I contacted carphone warehouse who said they do not offer support for that product and I would have to contact LG personally. I did that and sent pictures of the broken strap and they have decided the damage is down to "normal wear and tear". I am now not sure where to turn to next and any advice would be appreciated.

Hi I have a mortgaged property in which lives my in laws. They pay minimal rent, just enough to cover the mortgage. It was not bought with a buy to let mortgage. I am now about to change my family home and I will be looking to shop around for a mortgage on our new purchase with the help of a financial advisor. My question is will I have to declare this other mortgage or can I keep it under the radar. I have checked my credit file and there is no mention of this other mortgage. Thanks

Hi and thanks for replying. I understand 6 year rule it's just that in the month I made the final settlement. They insist on calling it a partial settlement. this is what it looks like: February 2014 PS Partial settlement. The payment status has been reported as in default. I an assuming in March there will be no other reporting and the defaults will start to drop off. The first was in April 2009 and so that will drop out in April 2015.

I have agreed a partial settlement with !st with the agreement that they or anyone else does not chase for the rest of the disputed debt. This was in Feb and I just checked my credit file and the record is marked as PS (partial settlement) but it still says the account is in default. This is not what I expected. Will this account stay open with the CRA and be reported on every month as in default?

Thank you to all who have offered advice. I have written again to !st and told them I am minded to make a complaint.

The usual story they refused to accept any liability or blame. I filed a claim at the small claims court and they paid up. It seems the only thing they are afraid of is the courts. Good luck to everyone else.

Another update on this long running saga. Every once in awhile !st try all different permutations of threats. The latest one is to now threaten me with bankruptcy proceedings. I would like to now make a formal complaint against them and maybe even ask for a 3rd party to resolve this. Who would be the body that I complain to? Thanks

Hi Sorry that is what I meant. My credit file is updated each month. A DCA cannot provide me with valid CCA and I have not been paying until they do. This has been going on for three years and I have 3 years do missed payments on my credit file.

Yes, I was successful with my claim. I did have to go the small claimes route first. I adopted a similar attitude to the one one I took with my bank charges claims. I 1. I ask for my money back. 2. They refused. 3. I asked for my money back and threatened court action. 4. They refused. 5. I instigated court action. 6. They paid up. I just refused to get into any back and forth debates and I think they understand that. It's part of the game to them. Good luck. -
Hi So if a default is added each month for 6 years then it will take 12 years to clear all record of that debt from your credit file.

Hi My question is about how long defaults stay on your CRA account. I know a debt is unenforceable after 6 years so would all default notices be removed after 6 years or would each default notice stay for 6 years. If that is the case a record of the debt would be on your account for 12 years. Thanks

Hi Just an update on this situation. 1st Crud tried again to pass this on to a different DCA. I seemed to have put the brakes on that again by using letters found in the library. As previously mentioned !st are still reporting this to CRA and I have a big black D every month since March 2009. Can I clarify that if I am prepared to sit this out then I only have untill Mar 2015 where the alleged debt becomes statute barred.

Just had an interesting call fro crapital 1 legal dept. They said they would like to ask for an extention. I said to put any request in writing however I would be answering in the negative. They said they needed a bit more time to work out the correct amount to pay back. I said they had loads of time when I made the first request and they refused to admit liability. I reiteragted that it was now in the hande of the court and we will stick to the couorts deadline.

Got home from work to find an 'Notice that acknowledgement of service has been filed' and that cap 1 has 28 days to file a defence. I am not sure when the timer starts. Is it 28 days from the initial submission of claim or 28 days from when Cap 1 filed acknowledgement? thanks

Hi Cap 1 have to reply by today. I am at work so won't be able to check post. Can anyone offer advice as to my next course of action. Is it simply filling in form I received from the court?
