  1. Hi remember me Jonni2bad offered some help with a letter and was wondering if he managed to do that. I would appreciate any help as I am not very good at putting letters together. I am keen to get this off the ground as quickly as possible. Thanks Missy

  3. Hi I entered into a cashback deal with e2save and when I made my first claim they said I did not send all the info they needed and my claim has been regected. I was also told that not only have I lost the first claim but I cannot make any further claims. The problem I have with this is I did send all the relevant info via special deliery but they are saying they did not receive it all. As well as the claim coupon I had to send the first two pages of my latest bill which I did however they are saying they only received page 1 of the bill. My assersion is that they have lost the second page. Can anyone inform me on where I stand.
  4. Hi Am I right in thinking that only some banks can apply for a halt to claims? I have a claim in at MCOL aginst the Yorkshire Bank and I noticed they are not on the list.
  5. Hi I have an outstanding elec bill (£1.5K) from a previous address. I have acknowledged the debt and set up a £100 monthly direct debit which is all I can pay at the moment. I do intend to increase the payments once my earning improve. Anyway I have received a letter from Revenue Assurance based in Hertfordshire saying the whole debt is now payable, but I do not have the money. Are British Gas allowed to do this after I agreed to pay and will this now be an adverse comment with a credit reference agency. I am getting really worried about this as I do not have the money to pay the full amount
  6. We seem to be going around in circles with this 8 weeks business. This 8 weeks nonsense is a complete red herring. If you have been following the threads in this and other bank areas you will see the banks come out with all sorts of guff to try and obscure the clear and simple process we have here. So I suggest you all ignore any obfuscation employed by the banks and stick to the clear timetable you set out. 1. get statements 2. work out charges 3. ask for money back give 14 days 4. send LBA give another 14 days 5. issue court summons 6. get the drinks in I have had 3 successful claims and helped 7 other friends family and colleagues and each time the banks have tried to bamboozle us with guff so keep your blinkers on and don't get distracted. good luck
  7. Hi I am no expert but if you can prove that your situation was brought about through unfair bank charges which snowballed into the situation you are in now then I would say the banks have a lot to answer.
  8. Hi I have two successful claims against HBOS with the second one going back 14 years. I am now making another claim for another account I had with them some time ago. Would you believe it but they have just responded with a standard reply saying their charges are lawfull and I shoud refer to my terms and conditions etc. etc. blah blah blah. Are these people stupid or what?
  9. Hi Just to let everyone know I have been successfull in claiming charges back to 1992. I already had a payout going back the usual 6 years so I thought what the heck lets go for the rest. I asked Halifax a schedule of charges for my complete banking history with them and I was sent a pile of A4 sheets 12 inches high. Anyway I toted it up and it came to £2870. I made the usual request and they made the usual reply with an offer. I refused the offer and they just paid up. The money was paid into my account, it took about 6 weeks from start to finish. regards Missy
  10. I am in the process of claiming back more than 6 years from halifax and they have just made me an offer of about 2/3 of my claim which I have refused. I am holding out for the full ammount and I am confident I will get it.
  11. I have been offered about 2/3 of claim before I have even sent LBA. I have replied with "thanks but no thanks" using the template from the library. It seems like Halifax are maybe seeing sense and have stopped pretending to go to court and eventually paying more.
  12. The address I received my details from was HBOS Business Risk - Retail (DSAR) Trinity Road Halifax HX1 2RG This was account details dating back to 1992.
  13. Hi I sent a letter on the 16 Nov asking for a list of all transactions and charges on my account since the account was opened, I think around 1993-4. Recieved a reply today which went like this: Dear Mr xxxxxxxxx RE: Argos card account number; xxxxxxxxxxxxxxxxxxxxxxxxxx I refer to your letter concerning the default fees on your account. As referred to in your letter, the OFT has issued a statement following its review of eight credit card providers. The OFT's statement sets out its view of the principle credit card issuers (not store card issuers) should follow in setting default charges. As a store card provider we have not been involved in the discussions between the credit card companies and the OFT. In managing your account, you have failed to make payments, or the correct payments as they fell due on a number of occasions resulting to £ 105.00 being charged to your account since 2005. As part of having an Argos card, you are responsible for making the required payments on time and we have the right to recover from you the costs incurred by us dealing with your default if you fail to make a payment when it falls due. Had we charged the £12 fee referred to in the OFT's report on credit cards the difference in your fees would have been just £33.00 in total. We value our relationship with our customers and always endeavour to resolve queries and complaints as positively as possible. Having reviewed your account, for the reasons stated above, we are unable to offer you a refund of fees however as a gesture of goodwill we are prepared to offer you £50 to be credited to your account. Our offer is made without admission of liability and in full settlement of all claims you may have against us in relation to the default fees on your account. I phoned them to inform them that what I got was not what I asked for but all I got was passed round 4 different departments and made to wait for ages, all on a 0870 number. I gave up in the end and I will write instead. Any comments on the above letter would be appreciated. missy
  14. Hi I am starting a new claim against the above. I have sent a SARN request on the 16 Nov 06 asking for list of charges but have not had any word from Cap 1. Is there a phone number I can call to remind them that their time is nearly up or should I just wait .

  16. Hi I have recieved statements dating back to 1992 and have tallied up all the charges. When looking over an old statement, 1993, I noticed that Halifax charged for using ATMs. The charge then was 60p a time. Could this be classed as a penalty charge if the bank could not show a breakdown of the true cost of the transaction. regards

  18. Hi I issued a SARN to the Halifax asking for all account activity since my account opened, 1992, because I intened to claim back all charges. I received a list of charges only going back 6 years so I phoned customer services and was told they only kept account details for 6 years on the system they had access to. I asked what other info was kept on any other system and was told it would not be transaction history and would only contain past addresses etc. To be frank I did not believe him. How do we know that what the banks tell us about about account history is true.
  19. Hi I have just sent a SAR to Halifax requesting All Information on my account since the account started 1992. I have already won back my charges for the past 6 years but I am now going for the rest. I to paid a lot of charges in the early days, when I was going to Uni, and it caused me a lot of grief. So good luck with your claim.
  20. I was also worried about the whole proccess but I was successful with my claim. Halifax paid up over £3000. They said they were going to defend but just transfered the money into my account within 10 days of receiving the court papers. Hold your nerve and stick with it. Just remember, this is your money that they have taken unlawfully, You are only getting back what is rightfully yours.

Hi I have already been successful in claiming back charges for the past 6 years from Halifax and after seeing others being successfull in claiming back charges past the 6 years I have decided to give it a go. I have phoned customer services to test the water and they have told me that the bank only keep statements for 6 years. How then have others been able to claim back. Regards
  22. Hi I have just received a settlement figure of £468.44 from Close Motor Finance and was going to pay it off at the end of the month. When I checked I realised it included £164 in charges. Do I pay the whole amount off then claim the charges back or should I pay what I owe and haggle over the charges later?
  23. Hi I was out of work for 6 weeks and have missed a loan payment. The company have phoned me and I have told them exactly when I will next get paid and when I will make the payment but they keep phoning me every couple of days asking the same questions over and over again. In particular they are asking me to give them a post dated card details which I refuse to do. I have now sked them to stop phoning me and conduct all future business by letter. They say they are entitled to phone me because I am in arrears. Where do I stand please regards
