Haha same person DJ, I am making a formal complaint to the SRA about his corupt practices once this is all over with you just wont believe some of the things he is coming out with !

Guys as interesting and intriguing as this thread is can we not be too specific with numbers and names.

I have some very good news. I received a letter from my local court a few weeks ago but was waiting to hear back from Northampton re another letter in relation to my complaint.

 

I have it in black and white from the county court that a in relation to my claim that there was no application ever made to substitute the claimant and secondly my partner has told me today that I received a response re my complaint, which confirms that Robinson Way and Company Limited did not use the correct procedure to change their name as the company had transferred to another company and had not simply changed its name. I have it in black and white that they had to apply on an N244 in relation to every claim that required substituting.

 

There are serious ramifications now for Robinson Way and 17500 claims and I will later when I get the chance scan on both letters and the email correspondence.

 

I have also got the SRA complaint forms to lodge a complaint against a certain solicitor at DWF.

 

 

Mods/Admin I have done most of the leg work but I think we need to go that final push as there will be many judgements in the name of Robinson Way and Company especially where litigation began pre sep 2009 and carried on after this date which will be invalid, and we need a bug gun from CAG to help!

I think RW will take this further with Northampton, as from the papers it looks like they had agreement to change the claimant details on the 17,500 existing claims. I would presume that that they will now take the matter up with a more senior judge to over rule the district judge. It does appear to be a change of company and not just a change of name, so perhaps there has been some misunderstanding between RW and Northampton.

I cant see how they can, the law is quite clear and you would think that a firm of solicitors would know what they are doing. An admin officer of the court is unable to bind the court to decisions. My take is that Robinson Way tricked Northampton County Court into thinking it was a simple name change. The senior judge would not be able to over rule the judge unless he was wrong in law and he is not. The civil procedure rules are very clear.

This does open up a can of worms for other companies as well. DCA's are quite often subject to company changes, as they are often owned by private equity groups who sell them after a few years. I am guessing that Northampton may have dealt with requests before on a bulk basis.

Lots has happened they have now made a formal application to substitute the party to hoist portfolio holding 2 limited. Here are some of the documents and I will place the rest later on !

Prosser you're a star!! Our full trial is listed for 25th March. I'll keep you posted :-D

 

If there is still Robinson Way and Company as the claimant they are in big trouble (especially if the 6 year limitation period is up)!!! If the claimant is Robinson Way Limited then they have a problem but not as much!)

Once my case is over I will disclose the full facts to the relevant authorities, there statement and the attached evidence that accompanies there application to substitute the claimant amounts to fraud !

Dont worry I have a number of forms to fill in, but I have been advised to wait till my case is finished. The one I'm most looking forward to sending off is this one !
