Hi all,

 

first off, sorry if this is posted elsewhere. I could only find old posts, posts relating to, but not quite this question.

 

I had an HP loan back in early 2000. Satander (Wagon finance) recently rejected my claim, saying basically:

 

'it was over 6 years ago, and since you have no paperwork - sod off'. (or words to that affect)

 

Is there anything I can do?

This may sound like a silly question but if you don't have any paperwork then how do you know there was PPI on the agreement, or is the lender assuming you have no paperwork?

 

Do you have anything at all?

I guess the question should have been:

 

Is there anything I can do to prove I had it either way? i.e I'm not sure 100% that I had it, just an inkling if you like. Am I peeing in the wind as I have nothing at all other than an account no./payment amounts of the HP the bank gave me?

You could try a Subject Access Request (SAR) to the lender. There is a template in the CAG library, the link to which is at the top of every CAG page in green. Cost is £10 and they have 40 days to comply. They will be required to send all of the data they hold on you. You should include a line that says it is to include copies of all and any agreements you have ever had with them. If they do not hold any data for you then they should return your £10 fee.

 

If this loan was paid off more than six years ago then they may have destroyed any data they have for you but it could be worth a tenner to find out.

 

See what comes back from the SAR request.
