Hi,

I am wanting some help on Motormile Finance Ltd.

 

They turned up on my doorstep demanding money for an unpaid fuel card. This fuel card belonged to a company that went into administration in April 2010. I was a Director.

 

They claimed that i had a Personal Guarantee [PG] on this debt [around £900]. They had no proof. He then said he would speak to the office and return at a later date.

 

I rang the office and they said that they would provide the PG but it would take weeks to do so. I then said i would do nothing until i had the proof. He then said that if i did'nt it was too late to wait and i would have the baliff's at my door as they had tried to contact me for months. Not true.

 

Silly of me but i was worried and had money so offered around £620 they accepted and i paid. I know i am a fool but have 3 children and did want a big scene with baliff's and such at my house!!

 

I do remember that the company owed around this amount to the fuel card. I can confirm figures they said i owed and what i paid to them, working away at present and they are at home.

 

Please can anyone tell me if i have a leg to stand on and what to do.

Pfft! They are just a DCA and their threat of bailiffs got them what they wanted... Your money.

 

It's easy to say this now, just a shame you didn't find CAG before parting with your money. I totally understand your situation and you not wanting the hassle of anybody turning up. Sadly, one letter printed off and fired to them would have been enough to keep these scumbags from your door.

 

I'd certainly send them a letter anyway telling them that if they wish to attend your property then they need an appointment, and that you won't be making one of these EVER.

Hi Welcome to CAG, I'm very much afraid you have been taken

foe an expesive ride here.

 

Before bailiffs can be instructed a Count Court Judgement MUST

have been mad, you would have had a claim pack issued and would

have to acknoledge service of the clain all the prelims, submitting

a defence etc then a hearing a judgement, if they won an order to

pay, if you failed to pay the order only then could they enforce the

judgement by using baliffs to seize goods for sale.

Make a formal complaint regarding the threat of bailiff action to Motormile

and a complaint to the OFT regarding this tactic.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
