My situation is a little different as my MBNA debt was part of an IVA accepted back in July. So, my account is officially closed and they're are only going to get back around 35% of the £2.5k debt I had outstanding with them.

 

Now, I'm still going back after my charges which amount to around £800. I sent off a standard "charges illegal", "request immediate refund of..." letter asking for a full settlement within 14 days.

 

10 days later and no response, but will update this thread as events unfold. Anyone with any experience and advice feel free to offer it!

Good luck with your claim - however, the charges are not 'illegal' they are deemed 'unlawful' - there is a difference.

 

What I suggest is you go back to the beginning and start here

Along with your cheque you may also want to send in some ID. Then follow the step by step guide for your claim. If you follow things to the letter then MBNA will know you are serious and realise you know what you are doing - good luck and keep us posted :-)

Thanks Redsue. I've already got copies of my statements and have sent a list detailing the charges I am claiming back.

 

Received the standard 'holding' letter today (bang on 14 days) saying they'll send me a full response by 23rd. Looking forward to the fight!

Well, I sent my LBA and it's now a little past the 14 days I gave them to offer me a full settlement. I will give it another day or two before filing my claim @ money claim online. I assume I am now entitled to charge interest of 8% on top of my claim? Using the 'simple' version of the template in the library this pushes my claim from around £800 to around £1000. Does this seem about right? Any help much appreciated as I dont want to do anything wrong at this late stage.

Statutory Interest

 

 

1. To calculate the "Statutory Interest" of 8% you must take 8% of the amount of your claim. For example, if your claim is for £3,000 the Statutory Interest of 8% would be £240.

 

2. Take the Statutory Interest figure and divide it by 365, e.g. £240 divide by 365= 65p (The daily interest figure).

 

3. Calculate the amount of days between the date of your claim and the final hearing. For example, if you started your claim on the 22nd Sept 96 and the Final Hearing takes place on the 31st Dec 96, then this is 100 days.

4. Multiply the number of days by the Daily Interest rate figure, 65p x 100=£65. This gives you the amount of interest to be added to your claim at the end of your case.

Aha! Thanks very much for this advice. I thought I could claim 8% on every charge since the charge was made! ie I had some charges where I was trying to add interest for over 2000 days (nearly 6 years).

 

I take it that I can't do this?
