ok just received my statements after going through them ive found

 

1. charges for returned dds ,arrears charges and so forth = £1250.00

 

2. on redemption it shows

 

final redemption charge £ 195.00

early redemption charge £1807.96

interest due £2923.30

 

now i was on a two year fixed rate and redeemed after 3 yrs 7 months

so advice from all you peeps out there and zoot your angle on this is a must !

i know i can go after the charges what do you all think about these other charges are they penalties??????

Think from 1990 ive had 5 including this one i have now lol . I would never have thought of going after them if it wasnt for this site just reading the threads and the help we can all give one and other gives you the inspiration to go after these charges which lets be honest about it we all thought were legal and above board once again zoot thanks for your advice and with the two results we have had today surely thats inspiration for us all !

just found the mortgage offer regarding this mortgage it says

if the mortgage is redeemed ,part redeemed or transferred prior to 5th anniversary of completion date a charge of 6 months interest at the prevailing standard varible rate will be made !

6 months interest sounds like a penalty. I'm sure they can relend the money in that time!

 

If you split the claims and run them at the same time you risk having them merged in any event. If you do them one after the other you risk having the second claim struck out as an abuse of process.

 

You could perhaps argue that the charges and ERC raise different issues and justify splitting them on that ground.
