      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello Capital One people,

 

Just starting a thread here to keep everyone up to date with this claim (currently tkaing cahoot and nat West to court also).

 

It's actually my gf's old card and after receiving SAR info yesterday (took just over 40 days c/o Miss Katherine Blunt) have totalled the amount owing as £360 plus about £80 interest.

 

Prelim letter being sent recorded delivery today.

Hi there,

 

I just wanted to check about claiming interest - I notice there is a separate spreadsheet in the library for credit cards but the interest seems the same as if it were a bank account. Are there any differences I need to be aware of? I assumed it would be 8% for each charge?

It would be, but you have a couple of options. 1) Claim the 8% but you can only do that once you have filed a claim with the court. The other option and my personal favourite is to claim contractual interest. This is the same interest that they charge you which you will see on the statements. My claim with them was at 27.9%. The beauty of this is you can claim it from day one in your prelim letter. The only downside is if it goes to court, you will need to convince the court that the charged interest rate should be reciprical, but I don't have an issue with this as I feel it would be difficult for the card sharks to argue against. If you go down this route, you can not claim the 8% when you issue the claim.

Capital One appear to be alot easier based on other threads.... hoping they pay up soon...

 

We have similar plans; no debt (just a mortgage) and no overfrafts... "wowow just the thought of that stress free life"

All I can say is I live in Portsmouth so....... :D

 

Perhaps with all our money back we can spend a little on season tickets for our respective teams..... (of course that'll mean I spending a little more ;):lol: )

 

Seriously, I do support Pompey but I am not a "massive football fan".... I think I attended a match once when I was about 7.... was it league division 4 then? :rolleyes:

 

And on a even more serious and relevant note; there was a double page spread last week in "Portsmouth News" telling the readers how to claim back money from banks, with a local man having already got HIS £3100 back from....

Well guess what.... letter arrived Fridat 1st December and we have WON the full amount - just waiting for the cheque to arrive and be cashed before informing the courts of this. How easy was that? It's the last claim (of three) I've filed and the first one to be settled.

 

Donation on it's way as soon as chq has cleared - can somebody change my thread to reflect this victory?!

Hey well i have just been told that cap one intend to defend the claim i made so am waiting now for there defense will let you know what happens anyone got any advice as to what i do next

 

Yes, just sit and wait, chances are their defense will be 'we have paid you the money you're claiming' so there is no case to answer. They then normally say that payment will arrive within 14 working days. However in my case payment has not been received after 21 days so if they don't get their finger out I'll be returning the form to the court saying I do wish to continue the action. Basic principle is wait until cleared funds are in your possesion before stoping any legal action.
