I am helping someone at the moment who has had some 5 transactions refused by topcashbacks team.

 

With the reason suspicious activity.

 

depsite openning a ticket etc they have had no joy.

 

At the last count topcashes system has closed the open ticket and no response.

 

The only option i can see for them is issuing a small claim.

 

The snag is where do i send the claim form ?

So whats cooking today ?

Hmm, now there's a question. I have just been over their website and cannot find a postal address for them. I guess they must have a Registered Office somewhere - so Companies House might be a place to look. Alternatively they are registered with the Information Commissioner - so I wonder if you would find an address for their Data Controller on there ? Worth a try I guess ?

Pre action protocol expects you to have attempted to resolve your complaint before issuing a claim.

 

Suggest you write to them under the heading of OFFICIAL COMPLAINT - set out your complaint and what you expect by way of resolution.

 

You could indicate that if your complaint isnt resolved within a certain period of time, you will be issuing a claim.

I was helping someone with this. After waiting ages a small claim was issued and topcash settled on a without prejudice basis.

sent complaint thru their site also asking if I was going to get an aniversary card in couple of weeks, as my complaint = non cash received is 1 year old then = no reply ignore that site if I were anybody on here they are full of Bull Shxt

I'm afraid that there is virtually no likelihood that we will be able to recover the cashback that you have been expecting in response to this claim from the merchant, as it seems that our efforts to acquire a decision have been unsuccessful. We can, nevertheless, appreciate that you have been very patient in and co-operative in allowing your claim to progress through the pre-set channels of enquiry.

 

In such situations, we can employ our 'Fair Play' policy to help ensure that there are no ill feelings towards the parties involved, and to help ensure that you have not lost out too much as a result of these circumstances.

 

Can we please ask as to whether you would be prepared to accept half the cashback you have been requesting, as being paid from our own pockets? This will be made as what we refer to as a ‘Manual Offer’ that you can click a button to accept, and have the corresponding amount applied to your ‘Earnings’.

 

If you do choose to accept this, can we please re-iterate that this can only realistically be a one off, as we simply would go out of business if we were to settle all disputes of this type in this manner. In not charging anything for the use of our service we don’t make any huge profits, and we are of course very dependent on receiving any expected cashback from the merchant so that we can pass this over to you.

 

Please let us know your thoughts.

Topcashback - Accounts to 31/01/2014

 

Revenue increased from £30.8m to £37.5m

- Cashback paid out = £32.8m

- Dividends of £1.4m paid to the 2 directors

- £255k paid in corporation tax

- Admin overheads steady at £3.6m. 90 Staff as at 31 Jan
