      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes...I will NOT use the missing months to show reasonableness what do you think ims?

 

...The Period from 06/10/2003 ....To.....-05/07/2005

 

OR do you think that that would be a size-able chunk...bearing in mind the above figures?

Ask them for the detailed breakdown of their offer to see what they have included.

 

Also ask them what they have done about the charges for which you have not got statements and what they propose to do to make it an equitable settlement

FINAL ANALYSIS

MBNA offer was £330.01 after only 3 weeks from a written letter by me to them on bhalf of friend....

 

They moved swiftly

 

Offer too low....Offer has been calculated on this thread with stat int to be £399.64..MINIMAL

 

Statements for Periods between 06/10/2003-05/07/2005 not supplied therefore unaccounted for....

 

ACTUAL REFUND should be in region of £475.00-£500.00...estimated guess

I have compiled a letter stating that the above is unsatisfactory and that a fuller breaksown is required and that xx amount of months are missing/unaccounted for when they sent SAR....

 

sent it off yesterday with nonsense cheque...

 

I shall post up the reply AND amount OR referral to FOS.

 

 

Just a quick question...

 

What category does PPI payments/CI from customer DEDUCTED from account fall into.

.i.e Balance Transfer...Cash Advances...Retail...Purchase...etc..

 

The reason is that I can then tell at a glance which APR applied to it at any particular time as opposed to Introductory Rates...

Just a little insight if you can....

 

How would you calculate repayments PPI from 06/10/2003 to 05/07/2005 when there are no monthly statements for that period yet evidence is present that PPI WAS added to account on that date....

 

The PPI has been calculated FROM 05/07/2005 until 03/06/2010 as all statements were provided for that date apart from some missing about 8 in between these 2 dates...

 

So i guess then ...how would you calculate unknown figures from 06/10/2003-05/07/2005..or what 'common sense/figures' would you use..

 

AND...the missing months in between 05/07/2005 and 03/06/2010/figures would you use...

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

How does one actually proceed to use method to work out refund plus CI plus Stat Int for missing months...surely the final total depends on compounding...and to take an average would be to discount that comopunding would it not....

 

For example 06/10/2003 - 05/07/2005 were not even in the monthly statements so have no figures at all for that period

 

05/07/2005-03/06/2010 there are figures except for 7 months in between that are missing...so surely the method for calculating both periods would be different...05/07/2005-03/06/2010 will obviously have figures either side of the missing months and so an average CAN be taken whereas not for period 06/10/2003-05/07/2005 for the period 06/10/2003-/03/06/2010

 

Any advice most helpful on this matter as I can then begin to start putting in a figure. for MBNA if they come back again with a nonsense offer..and use the method on my HBOS PPI thread without having to clog up your time:oops::-)...and also this is probably a common question for most caggers who can learn from this thread how to apply the 'method'

For the first batch of missing months, take the statements from 5/7/05 to the beginning of the next break. Work out that average monthly premium and use that for the first of the missing months.

 

For the 7 month missing period, take the statements from the end of that missing period to 3/6/10 and work out the average monthly premium from this and use that as the monthly premium for the missing 7 month period.

 

Don't forget, you are not going to be entirely accurate here...you just want get an idea of what the claim might be so that you can take a view on any offer that might be made.
