DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you dx, just concerned for a microsecond there!

Guessing from them keep trying to refer us to our own records they don't have much themselves.

Cheers Ford, yes we did, and Marlin sent a reply with the agreement missing lots of T&C pages according to DX

What would you guess their next step is? as they made a threat to apply for a strikeout

they may well make such an application, the '14 days' they state is about up. so you'll soon know.

if the agreement is after 04/07 as the allege, then an accurate recon at least wld be required on that.

what is an accurate recon?

an accurate reconstruction of the agreement rather than an actual copy of the original.

  • 5 months later...

HiHill!

So nothing for six months since I submitted defence, CPR to sols and New CCA Request to claimant...

Now received a r estons letter...

Despite advising you in April 2016 of the history of account, you have not withdrawn your defence etc...

The purpose of this letter is to give you one final chance to withdraw etc...

Please complete enclosed N9A and return within 14 days..

---------

So, ignore? template they have sent us?

Its weird how these companies come up at this time of year!

Does 6 months of no contact have any affect on them coming back now?

Many thanks in advance, as always

E

Yes it is Ford

"Last chance to withdraw your defense before an application is made to lift the stay, to strike out the defense and enter judgement against you for the full amount"

ok. they are poss having in mind going for summary judgment. a tactic that seems to be becoming more commonplace rather than letting the claim (trial) process continue in the first place.

no you don't reply

only to the court should they write

rectums do this all the time to unsettle defendants.
