Hi i'm posting this for my dissabled father i really hope someone can help me on this matter has my father as given up trying!!.

 

My father bought a 07 vw passat from the local garage & they sold him 12months warranty for the vehicle,

within 3months of purchasing the car there was a fault with the accelerator pedal.

 

He rang the garage to report the fault & they said to phone the warranty company which he did on more than a dozen occasions but could never get through to them ,

so he went back to the garage & ask to speak the manager a few times but the manager was never available,

 

being dissabled he needed the car so he took it to a VW dealer & they went through the small print on the warranty

& the problem was covered

 

the VW dealer wrote a letter stating this & carried out the work costing £900.

 

My father went on a consumers programme on the radio

they looked into it for him & said the warranty company had gone bankrupt before the policy was sold to him hense thats why he could never make contact with them,

& the radio said he's not the only person thats having the same problem with the warranty company.

 

He went back to the garage that sold him the car & they said they are not interested.

 

So if anyone could give me some addvice i would be grateful.

i am really suprised that the radio program said that

 

anyone in consumer advise KNOWS its NOTHING to do with the warranty - they are worthless

 

they are EXTRA on top of your statutory ringhts under SOGA.

Its the garage who sold it to him that are responsible, and who sold him the warrenty? was it the garage if so they shouldnt have if the company had gone bankrupt anyway. He has his rights under SOGA, the warrenty does not overide them.

As previously stated, your claim is against the seller. However, he is entitled to have the opportunity to inspect and rectify the fault in the first instance. Normally you would of prejudiced a claim by having the repairs carried out under your won initiative. But it appears that the seller sold you the warranty AFTER the warranty company went bump. In those circumstances, you position should be stronger. You need to send a formal letter to the seller indicating that the warranty co had ceased trading when they sold you the policy and as a consequence, you consider that they are responsible for the cost of repair. Give them 7 days to refund you the amount of £900 following which you will pursue the matter in the small claims court using the SOGA 1979. Send by recorded post.

i know that my father carried out the repair under his own initiative which worries me, but he could not make contact with the warranty co, & he needed the car as he's dissabled, thanks to all for the addvice. :-)

He did return to the garage but was told by the garage to contact the warranty company thus misleading the customer. Secondly if they sold the warranty and the company was already bust they could be in serious trouble with Trading Standards.

As I said previously, this shouldn't be a problem under the circumstances. I'm assuming that you can show that the warranty co had gone bump before the seller sold you the warranty. Also, it appears that the seller has fobbed you off by sending you to the warranty co. This could be interpreted as refusing their opportunity to inspect/rectify themselves.
