Could someone advise me please.

I have already claimed back charges that were applied to my account. i did file the court paper work but the Halifax paid me in full and the case never went any further. Since then i have been using the same account as normal and i have been wacked with even more charges. I started the process again of claiming the charges back by sending the preliminary letter and this is the reply i got.

 

Thank you for your recent letter.

 

This account has already been through the county court process and you agreed to settle, in full and final resolution to this complaint. As such no further charges will be refunded to you in respect of this account.

My question is are they correct in what they are saying can i only claim back charges for this same account once even thoe the charges are still being applied?

And how do they figure i agreed to settle in full and final settlement when all i did was issue the court papers.

Did you sign an acceptance form? What was the wording of it?

 

You should write back and say that the last payment was for full and final settlement of that claim only, and that this is a new claim.
