  2. Could someone advise me please. I have already claimed back charges that were applied to my account. i did file the court paper work but the Halifax paid me in full and the case never went any further. Since then i have been using the same account as normal and i have been wacked with even more charges. I started the process again of claiming the charges back by sending the preliminary letter and this is the reply i got. Thank you for your recent letter. This account has already been through the county court process and you agreed to settle, in full and final resolution to this complaint. As such no further charges will be refunded to you in respect of this account. Yours sincerely Iain Shearer Customer relations officer My question is are they correct in what they are saying can i only claim back charges for this same account once even thoe the charges are still being applied? And how do they figure i agreed to settle in full and final settlement when all i did was issue the court papers.
  3. I purchased a car on hp The finance company was Capital bank plc part of the Hbos group. The problem i am having is capital bank are trying to take more money every month than what it states on my credit agreement. The first payment they tried to take by DD bounced due to them taking more than shown on the agreement hence i got a bank charge. I phoned capital bank and was told they couldnt find my agreemnet they would ring me. Never happend..... I wrote 3 letters(recorded delivery) sending copys of the agreement and my bank charge and asking for the charge to be refunded. I got no reply at all. Whilst all this was going on i made 4 of the agreed payments by cheque which were all cashed after having no reply i stopped paying. Looking back now i think this was my mistake. For weeks i have heard nothing until today i got a letter from them saying that i hadnt responded to the default notice (Never had one) and that they were terminating the agreement and require the return of the goods immediately. My question is what can i do now i dont want to lose my car!!! if i was to pay the outstanding balance would that solve things? Can they terminate the agreement without sending me a default notice? when i tell them i havent had a default notice will it just be a case of them sending me a copy of one and the agreement will still be terminated or will that give me a chance to pay the outstanding ammount?

Hi Nellie, I too have had the same sort of problems with these people LogBook Loans(Tossers) I was in debt etc etc and got a loan from them and made the first few payments untill i was involved in a major car crash. My car was a right off as they had to cut the roof off to get me out. Logbook loans wound me up so much i now refuse to pay them anything. The last i heard from them they told me balliffs would be sent out my reply to them was the loan was secured on the vehicle (which is now the size of a micro machine) YOU CAN HAVE THE CAR!!! Ive heard nothing now for weeks. Im fairly sure they can't send the balliffs in as the loan is secured on your vehicle (im sure someone will correct me if im wrong) I think however that even if you sign your vehicle over or sell it etc and you still have an outstanding balance with them they can still recover that vehicle. My advice on the number plate would be to re register your vechicle with DVLA get a new standard number plate. You could in theory sell your number plate to your newly born child! No law saying you can't. I hope this has been of some help and that you and your baby are well and happy. These people are pure nasty i could of died in my car crash but all they cared about was there money. Stuff emmm.
  5. ok..... As i said above issued my claim on 9th of June The Halifax have untill tommorow the 23rd of June to reply as of yet they have not?..... Now just a moment ago to depress myself i thought i would check the balance of my account online. WOW there it was £2108.14 in my account. Im in absolute shock!!!!! is this money mine now im thinking or is this a trick and they will try to take it back tommorow??? LOL Thank you all so very much for your help here, if this forum had not been here i never could of done this. Just one last thing to anybody else claiming back these charges just hold in there dont accept there pathetic offers of half or less what your claiming you will get it all back. Good luck to you all.   6. My claim was served on the 9th June Claim No: 6HA01175 i now have a couple more questions. The bank has untill the 23rd of June to reply as of yet they have not. Why have they not replied? if they dont reply i can put in a request for judgemnet as i understand things but does this mean the court has the power to make them pay me my money back? Whilst all this has been going on ive been hit with more charges can i request to the court to add these charges to my ongoing claim or do i have to start the whole procedure over again? Thank you for your help in advance.
  7. I have followed all the steps to claiming back my charges and tommorow will be filling out the court paperwork (05.06.2006) I would just like to ask a couple of questions. Seeing as we have just had a bank holiday do i have to give the bank that extra day before i submit my claim. Also when filling out the money claim form, i assume i can use the template for this from the library do i have to calculate the interest and show it on the form and add it to the total or leave it? i cant see anything on the template regarding interest. I know that Halifax addresses have been posted but can i address the court paperwork to my local branch as this is where all my other letters have gone (by hand) Lastly i have read in another post that once the Halifax had paid back someones charges they got a letter basicly saying that they have paid the back the charges because it would of cost the bank to much to go to court and that if that persons account incurs any more charges they will be given 30 days notice and the account will be closed. Is this a standard letter that everyone has got after winning back there charges and could anyone advice me whether they can do this or if indeed they have done this. Thank you for your time. P.S im skint at the moment but when i get my money back i will be donating, thanks to you all for the hard work on this forum without it i would be none the wiser of how to claim this money back.
  8. Hello, I have a couple of questions i hope you peps can help me with, I have read the faq's but cant seem to find the answers im looking for. Firstly i sent my preliminary letter requesting my charges back (£1801.00) on the 08.05.2006 I handed this letter into my local branch as i did when i requested my statements a few weeks back and got reciepts. I have since had a letter offering me £280.00 as a good will gesture? which i refused and then i had a phone call offering me £747.00 as full and final payment which i refused also. I was then told that if i was taking further action i would have to send all the paperwork to the Halifax legal department. Is this right or can i hand it into my local branch as i have been doing and should i put my local branch address on the court paperwork? Do i have to send them the 2nd letter (LBA) giving them another 14 days, they seem to of made it quite clear on the maximum ammount there willing to give me so can i just start my claim or is the LBA a legal requirement? Also the nice lady on the phone advised me that the Halifax had never paid anybody all there charges back and had never been to court??? Has anyone ever lost a case for there charges to be returned from the banks? Has anyone ever been to court and had to fight it out on the day with the bank? All of these things are now worrying me as they quite clearly aint giving me my money back without a fight. Thank you for your help in advance.

Cheers mate, Firstly yes my credit is very poor i dont think i could get credit for a mars bar! :] Also i have just been going through some of the letters i have had from the Halifax and i found this one below (this is word for word) Thank you for your letter dated 16/03/2006 requesting information on your account for the last 6 years. Copies of bank statements can be provided with this information on, there is a £5 charge for this service. Please can you contact us to confirm that you wish for us to proceed with this request, and that you are willing to pay this fee. In regard of your enquiry about manual intervention on your account, bank charges are automatically and no manual intervention takes place. if you require any further information, please contact our customer care team on 08457 20 30 40 Yours sincerely Lauren Kirkwood Customer Services Im not sure if this helps having them admit that these charges are churned automatically but i thought id post it anyway.
  10. Hi there, I am looking for some advice please on a couple of issues but i will first let you know how far my mission to reclaim my charges is going. I got my bank statements on the 16th March 2006. Sent my first request for repayment of charges (£1801.00) on 8th May 2006 Got letter from Halifax on 16th March 2006 offering me £280.00 as full and final payment. Phoned the call center to discuss and refuse the offer and was told they could up the offer to £747.00 and that would be the final offer for a full and final settlement. Again i refused. The questions i now would like to ask are. 1. How and when do i work out and add interest to my claim. i do not have an overdraft on my account so can i still add interest and if i can do i add that ammount to the final demand letter? 2. I have had a letter from the Halifax stating because i have gone overdrawn(because more charges i dont have an overdraft???) i will be charged a further £28.00 on the 30th June 2006 can i add this amount to my claim? 3. I am slightly concerned that they can shut my account down and would like to know what the real chance of this is. Has it happend to alot of people? Thank you for your help in advance. Tony....
