I had an awful time with this company a few years back.

 

I missed a grand total of 2 consecutive mortgage payments due to circumstances beyond my control and from that point onwards my life was made a complete misery.

 

I had charges added all the time £50 a pop from what I remember.

 

I was taken to court and had a suspended repossession order made.

 

I was charged £100 for a counciller to visit me at my home which made no difference to my situation..

just worse by charging me £100 for it when I didnt ask for it.

 

I finally got out of the strangle hold by selling my house.. at a loss of £600.

 

This may sound like nothing, but I had owned it for 2-3 years..

. sold it for the same amount as I bought it for..

. and had a £12,000 deposit on it!

 

I have nothing but bad memories of the place.

But then I read somewhere that it was possible to reclaim charges that mortgage companies made.

 

Is this the case?

 

If so then I would like to know how to go about it.

 

Maybe I can have one small victory over this horrible company.

yes ofcourse you can reclaim all those and the fake debt management fee.

Right, I cannot find any of my old statements, so a SAR is the next step.The problem is I do not have my account number or any other such information. I closed the account when I sold my house 3 years ago.How do I do a SAR without this information?Also, does anyone know a contact address for this company?Thanks in advance

HelloI had a similar nightmarish experience with Capstone some years ago which resulted in my property being repossessed in 2007 ( a few days away from the completion of sale). I am looking to reclaim any unfair charges but got rid of all my statements etc. with them. So I have no account details. Can I still make a claim? Thank you.

Sounds like you are in the same boat as myself, though I did manage to sell my house during the suspended order.Im going to send the SAR request of to the address mentioned above with my name, address, DOB and time lived at the house in question.See what comes back. Maybe we should fight this together?

Well, I got a responce acknowledging my SAR request.The £10 cheque has been cashed so am now awaiting the actual paperwork to follow through.Will post back when it arrives!

 

That's good. They received my request also and I was told that yes it would take up to 40 days but would probably arrive sooner. Let's hope so.

Hello All

 

Sounds like we're all at the same stage of proceedings, but unfortunately I still have an outstanding loan agreement with them but with no arrears now. Sent my SAR off on March 23rd and got all the info back a couple of days ago, 17th April. Will be subscribing to your thread and maybe we can help each other along. Will be starting a thread of my own up too, but good luck.

 

The address I used was: SouthernPacific Personal Loans Ltd, St JohnsPlace, EastonStreet, HighWycombe, Buckinghamshire, HP11 1NL

Aren't these guys now called 'Acenden', which is the servicing company behind the owners of the mortgages who are called 'Mortgage Funding 2008-1 PLC'? So, are you absolutely sure that the above is the correct address for them, as Southern Pacific has nothing to do with them any longer? Of course I may be totally mistaken.

I decided that I was going to pursue SPML as they were the ones that I took the loan out with. The address above is a point of contact they gave me some years ago with a statement, so hence why I used it. Never the less, they received it and got all my information that was requested in my SAR back to me in under a month! The correspondence I have received from them has been headed from 'Ascenden', though.

I make you right Joy, as long as you get what you have requested and in full, then who cares!

Ok, so my SAR request has now been returned and I have all my past statements!

What next?

I can see that straight away there are lots of charges...

Arrears management fee

Early repayment charge

Adjustment charge

Repayment charge

Interest on arrears

Early repayment statement fee

Admin fee

Legal costs

Unpaid direct debit fee

Arrears councillor fee

Litigation fee

Insurance charge

 

According to the statement these run into several thousand pounds... What do I do next?

Ok,

So I have now completed the spreadsheet... and the charges run into one hell of a whopping figure! Thousands!

 

Thing is.. I dont know if I should/could try to reclaim them all. There are about 15 different types on my statement.

Is there anyone out there that could spare the time looking through it and giving their opinion?

but conv to pdf

 

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

.

ENSURE: remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

.

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

was your mortgage rate 8%?

 

ideally you should use the FosRunningPPI v101.xls

 

put your motgage APR in D13

and READ the RED NOTES TAB

 

i dont think you can reclaim the int on arrears either as the spready does that, but if it looks like they have added

normal mortgage ins to this interest on arrears then you can.

 

unsure on CBD or ins charge but anyhow as these are insurances not PENALTY fees they need their OWN spreadsheet.

 

were you made to take out life ins or buildings ins when you already had them then?

Thanks for looking through the spreadsheet.

No, my mortgage rate was variable and through that 2 and a bit year period the rate changed pretty much every 2 or 3 months. Do I need to do a seperate spreadsheet for each different APR?

 

The spreadsheet you have asked me to use looks like its for a credit card rather than a mortgage?

 

As for the insurance charges..

The CBD own insurance charge I have no recollection of. The insurance charges that have been made are in relation to the arrears I think as the insurance I had was building insurance only and that was built into my monthly payments rather than being an extra charge.

 

Looking through the data sent to me via the SAR request I have noticed lots of other charges too that were set up at the start of the mortgage.

Things like...

Arrangement fee £500

CHAPS fee £40

Arrangement of own buildings ins £50

Higher lending charge (because I am borrowing 89.92% of the property price) - £1331.25

Valuation fee - £339

 

Are these reclaimable too or are these fair charges?
