Hi

 

This came up in conversation today and I am not sure where to ask. I immediately thought of this site and hoped that someone would steer me in the right direction. Sorry if it doesn't belong. Hoping someone can help.

 

Can an ex partner, ie ex-wife, have the right to put a charge on our property for a small debt owed to the CSA - (partner been ill and not earning). The debt belongs to my husband - her ex, and the house is in both our names? We have other debts that we are fighting at the moment - including the mortgage co. who do have a charge on the property, obviously.

They sent copy of original agreement (bad copy).Felt I had to comply to stall. :mad:

 

Halifax/BMidshires - Mortgage - £18000 - In process of beginning to sue for them selling the house (after REPO) below the market value. :mad:

I think if you hubby pays the CSA directly, then they would put the charge on, but that's a bit drastic for them. Not totally sure. You can fone land registry & find out what charges are on the property.

FWIW

 

Im no expert on the CSA but it seems to me (from my experience as a former victim) that their primary means is to get cash from the husband to pay towards his children.

 

I always thought they were only interest in salary/savings rather than property.

CSA are able to register a charge against property in order to secure their interest in arrears of maintenance.

 

They did this to me and I am still trying to get it removed, or for the CSA to even talk to me about it even though the debt is fully repaid.

 

Long story going back 10 years but briefly CSA tried to screw me for £20,000 unpaid maintenance :o . They eventually agreed with me that it was £1400 but by this time they had a charging order.
