Hi there,

 

Through Muck Hall being involved for a QQ account (that I have a thread about in the Payday Loan part of the site) they have suddenly decided to also start chasing me for a catalogue account that has been dormant for a number of years (sadly not 6 yet). I previously received a letter from them saying they have been assigned this debt.

 

I received the following letter this weekend

 

NOTICE OF INTENDED ACTION

Dear Feebee_71,

 

We are under instructions by our client to recover the outstanding balance of this overdue account. This letter fulfils our legal requirement to inform you of our client's intended action, even if you do not acknowledge this.

 

It is now imperative that you contact this office within 48 hours to settle this account. By doing so, you are showing an interest to resolve this matter and we will endeavour to come to an arrangement with you.

 

----------------------------------------------------------------------------------------------------

 

Should you decide to ignore this advice, our client will not hesitate to instruct the appropriate action be taken to recover the outstanding balance in full. Disregarding this letter will not make this problem go away.

 

Please call the Action Prevention Team at Mackenzie Hall today on 0844 411 5630*, to prevent further proceedings commencing.

 

Payment can be made over the telephone by credit or debit card. Alternatively, you can make a payment online by visiting: www mackenziehall.co.uk

I am not sure this is the same as the first letter I got from them for the other account they are chasing. What can I expect to come next? Will it start on their merry-go-round of letters from them, Meritfarce and OPUS/DERS. If I know what is to come then I will be better armed to ignore them!!

Would that bit be so they can be fairly certain they have the right person as you wouldn't be opening someone elses mail would you.

Considering it's illegal to open mail addressed to another person of course not!!

 

Then again, the only post that comes here is for me as I'm the only person who has lived at this address for the last x years and since the building was put up on the site of previous properties with the same addresses - I dealt with all the post for previous occupants a long time back.

the CAG library.

Silly question (I am known for asking them).............

 

Why would I send a prove it letter for a debt I am aware of but have not acknowledged for at least 4 years?

So if anyone decided to ring that number to say 'it's not me' then they can be fairly certain they have the right person.

The letter goes to MH.and now they are on the

track of another debt it seems out of the blue

after dealing with a previous debt.

The letter is simple:

Dear Sir or Madma,

I Do not acknowledge any debt to you

or any company you may claim to represent.

I write in reply to your recent letter in which

you allege a debt is owed by me to your

''client'' please note I will not communicate

futher until proof of any liability is provide.

 

Send if you wish or ignore until they throw

their toys out of the pram:madgrin:

With the other debt they are chasing I sent a letter when they first got in touch and made an offer in keeping with my circumstances - they chose to ignore that letter and I have had many others from them since.

 

I think I may continue to ignore them for the time being on this debt too - in fact, when I first opened the letter I assumed it was to do with the other account!!

Mix of myself and parents having hospital appointments - last week it was mum and this week it's dad and I.

 

I should get shares in the hospital parking facilities - though it will have been 4 different hospitals in 2 weeks this time round!!

And here was me thinking that financial institutions had to treat customers fairly.

 

This must be a blatant attempt at pressurising people into making ill-considered and hasty decisions and therefore must surely be against their own code of conduct? Not that they would adhere to one anyway.

 

I interpret that to say (as any reasonable person would) that if you do not contact them within 48 hours they will not come to an agreement with you so will not treat you fairly after that point.

 

It also almost certainly prevents contact by any means other than telephone as you can never prove that post or e-mail was actually read by the right person within the 48 hours. That surely is also unfair.

 

It is also totally misleading as it tells you that it is a NOTICE OF INTENDED ACTION and says "This letter fulfils our legal requirement to inform you of our client's intended action, even if you do not acknowledge this." But then fails to tell you what that action is, no mention of legal action, doorstep visits etc. That once again is surely very unfair.

 

This letter is a disgrace!!

oh and ive rather slimed your thread count

you are now done to about 20

 

try and refrain from starting multiple threads about the same debt huh...

 

took me an hour to fathom that lot out...##nice and neat noew if you click your username / view threads.

 

next time

check you've not got a thread already running

before you start another one...

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
