Your first letter will produce a letter giving a goodwill geusture of £40 or the last 2 charges incurred.

 

If you then send another letter quoting your case etc, they will respond with how the consumer contract regulations are and how the OFT is on therir side, well they don't actullly say much, then drivel on about how they make their charges. Finishing with they will not move from there decision and it final. They never ever will mention the penatly contract clause, as they do not want to even acknowledge it exsists, let alone try and defend it.

 

The thrid step should then be submission of claim, but 3 things to remember, make sure you can afford the next month min repayment or you will have to suffer another set of charges. Also remember to see if the amount you will recover will cover the amount owed, otherwise they might call in the debt and it will be more hassle if you can't pay in 30 day s time. Lastly make sure you have every thing for your case before you start the claim.

Another thing to remember is they may be saying these,

 

"our system charges you automatically"

 

"this is because you did not keep within the T&Cs"

 

 

all this is very good evidence, but they do not link it with any arguement against the penalty clause law, you have to do that bit for them so to speak.

Hi Russell......how long did your statements take to come? I've requested mine but trying to work out a proper timescale for getting my claim in. I've decided (based on advice from here) to work out how much is owed before sending my initial letter in.

Capital One, quite possibly are now taking measures to act within the law.

 

All to be confirmed........

 

But only on accounts where they are being challenged, please post or inform me via private message if;

 

1. The credit agreement is not being enforced anymore (no charging)

2. Statement information is being altered

3. Delays recieving monthly statement (being checked before posted)

4. Any other un-usual happenings or circumstances
