      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Firstly, although this is my 1st post here i have been an avid lurker and have been greatly educated in regards to debt and what the DCA's can and cannot do.

 

Now, on to the first of many issues i have.

 

On the 21st December i took out a PDL with QuickQuid for £350.

 

Before the end of the year i lost my job (its a long story but basically i was suspended without pay on the 13th December for a "disagreement" with a manager, my employment has since been terminated).

 

This resulted in myself not paying the 1st repayment fee to QQ, expecting them to keep trying to take money when i have none i reported my card lost and now have a new one but they still have my account number and sort code etc...

 

I'm currently getting phone calls from them (they sound american) at the rate of 1 per day.

 

This morning i finally told them i had lost my job and he then asked if i was on benefits to which i replied "no, and its doubtful i will be able to claim for 6 months" to which he said i should borrow from friends or family, again i said no and he basically said we'll keep trying to collect on this and ringing and emailing you until payment is received.

 

What would be my best course of action on this? i have no income at all but i could scrape up a few quid a week to pay them but from what ive read they dont accept payment plans.

 

As for the security issue, they never ask for security details, they ask to speak to Joe Bloggs to which i reply "speaking" then they go straight into why they called. i questioned one of them as to why they arnt confirming my identity to which she said "you said you're Joe Bloggs, That's alll we need" so i said "But anyone could claim to be Joe Bloggs" she wished me a good day and hung up!

 

Any advice is greatly appreciated!

Contact your bank and tell them your bank details have been compromised and ask them for new sort code/account number. Or do you have another bank account you can get any monies paid in. QQ will try to take money out of your account as you would have given them authority

Thankfully it's not an account i keep any money in, it's the only one i have with a visa debit card so i transfer money into it when i need to pay bills online etc...

 

The only money i have in that account is gone on bills within minutes of me depositing it.

However, they will try and take money out which may result in charge from your bank. Cancel Direct Debit instruction with bank

They are American, and the drawling accent is enough to wind you up; their selective hearing adds to the wind up. QQ are duty bound to take into account that you have lost your job. Take it to the resolution centre on the QQ site, and head it COMPLAINT. If you were not totally at fault for the 'disagreement' with a manager, you should still try to claim benefits. If the manager states that you were dismissed for misconduct (which is one of 2 options; the other is leaving voluntarily, both of which can lead to suspension of benefits) you have the opportunity to respond to Jobcentreplus in defence of your actions.

Ultimately i left due to illness and i'm now in receipt of incapacity benefit/ESA.

 

It's a long story but basically a family member is a director there so the what's and why i left got "changed".....

 

The last time i spoke with QQ i disputed the amount due around £580 and mentioned that i should and will only pay the loan amount and one months interest to which he agreed and then said it comes to £460?

 

I asked him to send me a letter or email stating this and how they came to this amount (as it still seems wrong to me) and he mentioned something about a setup fee?

 

I have yet to receive this letter or email, what should my next action be? i'm tempted to setup a standing order for £5 per month to the details found on this forum. Is that a good move to make at this point?

 

And what can i do to get them to tell me the amount due? (loan amount + one months interest)

As Quickquid are not playing nicely (not that i expected them to) can someone please provide me with up to date details on the information i need to setup a standing order to them?

 

If they're not going to come to a mutual agreement with me then they can have what i can comfortably afford and not a penny more.

Go on my forums and read up on qq go to the qq site and chat to them tell them u need help as qq are now helping people more than before but dont trust them ever as they raided my account and im rid of them now but yes talk on live chat to them and ask for a payment plan they do them over 3 months and six months xxx

Already tried that quackquack, been emailing them back and forth.

 

The first offer was more than double my monthly income.

 

The second offer was £10 a month less (which of course was still over double my monthly income).

 

The 3rd offer was another £10 less and still double my income.

 

All offers from then on have been the same as the 3rd.

 

I want to pay them but i can't give them what i haven't got. It's that simple.

 

They refuse to give me details to setup a standing order but they have given me an address to send payments to so they'll be getting a postal order every month for what i can afford. That way at least i'm showing willingness to pay and that i'm not just ignoring it.

 

If they don't accept that or kick up a fuss, tough. I'm quite happy to let it go to court where i will ask the amount to be reduced (once they explain there charges and fees) or if they want, a DCA who i will then attempt to setup a payment plan with and the "no, not enough" roundabout can start again.

 

Quite simply, i cannot give them what i don't have.

QQ are now wanting £80 per month for 10 months so worse than they offeres before & have sent me an address to send payment a PO box number or I can set up a direct debit or give my bank card details (dont think so)and also this was in the email, Any repayment offer less than the one offered would not pay QuickQuid back in an acceptable timely manner.

They are not allowed to demand repayment terms if you are iin financial difficulty. Terms have to be mutually agreed and not dictated by the creditor. They also have to take into account other creditors you may have plus expenses and not leave you in further hardship. Even if it means they only get £1 a month for the forseeable future.

 

Even if they took you to court (which would be a long way off), a judge would state that to them and also enquire why they think their low priority amount is higher priority than every other creditor you have.

Bad BAD idea. Paypal is very unsecure and is regularlyused by criminals, due to how easy it is to launder money or be fraudulant. Not to mention it is very easy to falsify transaction numbers to get guaranteed payments. Plus paypal now requires a valid debit/credit card or bank account attached to it.

 

best way to pay them off is prepaid card that you can throw away if they start messing around, or standing order. If they still mess around, theoretically you could use a postal order.

Sorry but Paypal is not totally secure, it has problems (I've recently experienced one with them that nearly left me out of pocket).

 

If you pay using Paypal get a pre-paid debit card and use that, or get a separate bank account for payapal transactions only.

 

Don't take any chances with any Payday loan company having access to your income.

Paypal is NOT totally secure. Otherwise it would be a popular payment for everything. If you want to pay by it, then its fine, but there are way too many ways to use paypal fraudulently and also for the other party to take out payments. Especially if they ask you to set up a standing order/subscription payment.

 

I've had a paypal account with approx 10k of currency through it since 2003/2004. I stopped using it in 2010 because of the security issues.

 

But it's up to you if you want to take this advice or not. I still contend that the absolute best ways to pay off creditors is either standing order or prepaid credit card.

Quick quid will not accept pre paid card ever .nothing is totally secure but i use paypal have done for yrs with zero problems ever and qq will not accept standing order so pAy pal is the best option its as safe as a bank account im sorry u had issues ur self i never have but overall its the best way to pay

standing order is done from your bank to another account. It is a feature for regular payments to another account, but ONLY for amounts that YOU decide and on dates that YOU set. It cannot be changed by anyone else.

 

A subscription payment is very insecure feature by paypal. There are too many reports of people setting up subscriptions to different companies in the same way a standing order is set up, only to find that the amount was changed or that when they cancel it, a few weeks later, they find it hasnt actually been cancelled at all, and payments are still being authorised.

QQ do accept prepaid cards tho. Every single PDL does. You just write to them or email them with the card details and they treat it as a normal card. If you tell them its a prepaid card, then of course they wont accept as they wont be able to debit the account as and when they like to get as much money as they can.
