eviction order for Tuesday PLEASE HELP - I went to court back in April and payments were agreed, since then due to some circumstances I havent paid my mortgage July Aug and Sep and the Building society say my arrears are just over £3000 but i assume this includes there charges?? As my mortgage repayments are £450 per month, I have offered to pay £1000 today but they wont accept this,

I have no where to go and cant cope - I rand the charity HRAC who put me in touch with someone from HMS who say they can stop this but the charge is £650 I am thinking of taking this risk but would rather pay the £650 to my mortgage as oppose to a compny I know nothing about but dont know what else to do

Any help greatly appriciated

Sent a message to Ell-en, do not worry and do not pay money to ANYONE but your mortgage company, you have done the right thing - people who will help for money are normally a bit suspect, so treat with caution. It may be possible to get this stopped for £40 court fees and sorted out

There are numerous people on here with a wealth of knowledge regarding situations such as yours.

 

Can i suggest you start a new thread with your circumstances, post as much detail as you can without any identifying info etc.

 

You will get a far better response with your own thread.

I know I should of kept up the payments and am in the wrong but I have also secured a £300per mnth pay rise at work as from this month that will also help

Have a look here ellie, i'm no expert in this area but it has been flagged up for Ell-enn to have a look at, she is very knowledgeable in this area.

 

In the meantime i think you need to fill in and take a form N244 to the court today if possible and certainly by monday.

Hi, please do not give £650 for someone to do what you can do youself with help from us. You can get a hearing in front of a judge to get the eviction stopped but you will need to act today and I should be able to get online most of the day to help you.Firstly, do you have access to a printer?

Hi Sorry I was only on line first thing this morning I have filled in the form you have advised today and will take to the court Monday as I booked a emergencey holiday from work

I have attached all the emails that I have from Leeds to show they wont enter into any negotiation with me and a letter from my employer showing my pay rise so hopefully this will all help

Thanks all for your information and support - I have ignored the calls from the guy HRAC put me in touch with and not paid anymoney, which to be honest I would of had I not found this site and had your support

What did you put in Q10 of the form? Did you do a budget sheet to go with it?

Hi Ell-enn, Yes I did a budget sheet, and for Q10 I put the full circumstances of why I missed 3 payments - Financial and personal problems Along with the fact that I have tried to come to an arrangement with Leeds but they wouldnt accept any offter I have made along with teh email and letter prints outs to support this. I also have put in some details about the arrears as when I spoke to a (unhelpful) women at Leeds she said the arrears were £3500 and when I asked for full details she said as I had misse July - Sep payments but when I asked how much they were she said £352 per month which doesnt add up also I have a letter from leeds dated 2 Sep that says my revised payments are £383???

Do you think this is ok?

Did you quote the Norgan case law and Administration of Justice Act? It's best to do a statement to affix to the N244 setting out the circumstances and your offer of payment. Do you have a printer at home?

1. Is the mortgage in joint names?

2. Do you have any children?

3. What was the reason for missing the payments?

4. Do you have proof of your salary increase?

5. Did you use the budget sheet from this site ? (I have affixed one to this post)

6. Who is the mortgage with?

8. Do you have proof that you have the £1,000 ready to pay

3. What was the reason for missing the payments? Split up from partner who left the property and due to the reasons why I was off work and streessed

4. Do you have proof of your salary increase? Yes I have a letter from my employer that they sent to my home address

5. Did you use the budget sheet from this site ? (I have affixed one to this post) - I didnt use the one attached but will re do and use this one

6. Who is the mortgage with? Leeds Building Society

8. Do you have proof that you have the £1,000 ready to pay - Yes I can do a screen print or print of my bank statement

OK, I will start to draft a statement but it will probably be tomorrow before I post it on here. Can you be online tomorrow?

 

You will need the completed budget sheet, a photocopy of the letter from your employer and a screen shot showing the £1,000. Also, do you know who you spoke to at the Leeds who refused to take your payment? and the date and time of the phonecall?

 

What was the reason for the original arrears that brought about the hearing in April?

 

In the meantime have a read around the Repossession Successes forum,http://www.consumeractiongroup.co.uk/forum/forumdisplay.php?327-Home-Repossessions-successes that should make you feel a little better and you will also find how to fill in the N244 as there are instructions on lots of the threads in there, together with examples of defence statements.

Thank you very much, I can try whilst on my break as I am at work 8-6pm tommorow, it was due to debt and the fact that I and my ex had credit card debt etc and had been trying to keep our heads above water and in my lack of wisdom and due to the letters we were recieving we tried to clear these which I have now managed to do.

The call was at aprox 4.10pm I asked for her name to record it but she didnt give it

If you can pay the £1000 tomorrow (are they open?), that would be very helpful to your case. You could then print off proof of the payment and we can attach to the N244.

If you are on internet banking the transaction should show up after you have paid it ? a screenshot of that would be OK
