When i put in for charges back i have gone back an extra 6 months, how can i rectify this before i take it to court. it should have been in court weeks ago but realised how stupid id been please help

How far have you gone back? My claim is going back to May 00 because that is the data they have sent me.

Settled at 50%

Clydesdale £155. Should have been £310 charges, plus interest :( Husbands Account.

 

 

SETTLED IN FULL:

MBNA £1230. For Hubby.

Halifax £39.

RBS £342. For Hubby.

Cap One £200.

Abbey:

:D Settled in FULL April 18th 2007. £5179.83 Paid but what a long battle!

Not sure if its 6 years from court date or 6 years from date they received your SAR (Unless you have taken a lot longer than normal to get through stsges to court). I would guess it would be (Or should be) from the date of receipt of SAR cos its the Bank who have delayed paying up so surely not your fault?

 

Also have heard of a few people claimg longer - think the argument was along the lines that you only just found out about these illegal charges so couldnt claim before.

 

I guess someone with more time and experience will clarify for you/us!

As im in scotland i can only go back five years, i put in the months from when i recieved bank statements if i put claim into court i am wondering if they have grounds to throw it out

I dont know anyhting about the scottish system, have you posted in the scottish forum too?

 

FWIW i doubt it wuold get thrown out, they would just disallow the out of date charges.

 

Oh in england the time period runs from when the offence occured or when you found out or reasonably could have, theres also relief for mistakes of fact and law where the time runs from when you disciver the mistake.

 

Also if the defendnat concelas the unlawful nature of their charges then that also changes the effective time.

 

I thought that the scots regs were the same as the english ones in this respect. be pleased to find out if thats right/wrong.
