  1. Thanks for reply As im in scotland i can only go back five years, i put in the months from when i recieved bank statements if i put claim into court i am wondering if they have grounds to throw it out
  2. When i put in for charges back i have gone back an extra 6 months, how can i rectify this before i take it to court. it should have been in court weeks ago but realised how stupid id been please help

    Hi just an update to say i think ive made a mistake i have requested a refund of charges going back five and a half years instead of the five allowed in Scotland will the court throw this out or have i got time to change this, i have not put my claim through the court as yet but abbey have a copy of the spreadsheet detailing what i shall be claiming,

    Yes this is the last one sent the first 14 day one . waited then sent letter before action, giving them 28 days in total hope this is right. I will then wait till the 14 days is up and take it to court if i have not heard anything

    Just a quick update as to where i am now, have sent letter asking for charges back have had no reply, sending LBA on Monday giving final 14 days, getting bored with it now but not giving up.:-|

    hi Im not that far in front of you abbey sent my statements after 42 days. This is normal for them, they hold out until the last minute. good luck
  7. Thanks for reply the 40 days are up i have emailed commissioners office, my problem is what do i put on papers for court regarding non compliance, by the way my bank is the abbey. thanks for help. jacks
  8. I am handing in my claim for this years bank charges as the bank have not issued the rest of my statements can i put on the same form that these have been requested and that they are in breach of the data protection act, any info gratefully recieved as these are due at bank tomorrow.

    Just an update as to the ignorance of abbey, have went through the various steps as suggested and abbey still continue to ignore, have sent letter before action which is up on sunday, for failure to send information, phoned head office today and they say these must have been lost in the post i will recieve these by friday, not holding my breath, have also emailed information commissioners office today. Can anyone tell me what it costs to take them to court for non compliance thanks jacks

    Thank for reply, as im in scotland i can only ask for 750 at a time, i feel if i ask abbey in letter for 5ooo and break it down to smaller claims in court abbey may ask to have it all put together in one claim.

    Just an update on where i am now have requested documents, paid fee, recieved the normal microfiche argument, 40 days are now up, have sent letter before action, my question is if i send abbey a letter asking for a refund of what i think they owe me, can i only ask for 750 pounds at a time or do i ask for the whole amount and cut it into smaller chunks when it goes to court.

Hi Sorry if this is someone elses thread dont know how to start my own here, i recieved a ticket from blackpool borough council yesterday, i was in a disabled space displaying a disabled ticket and got a ticket for not displaying a timer, is this right, we do not have to display timers in scotland.

    The statements i have recieved are only from may 2005 until april 2006, i am also very surprised, i will wait for the next 5 years to arrive if these are the same there is something wrong, i got hammered with charges as a student for 4 years.

    Hi These are proper statements, the closing balance does show on the next statement as being the same, very strange then to have so many unpaid dds and not be charged by the abbey.
