Hi there,

My partner was removed from her course in Febuary this year, for non-attendance(total rubbish, she had medical reasons for not attending and the uni promised her help but then changed thier minds). Student loans company were covering her tuition fees.

We moved not long after that, and I today got a waft of mail from the Uni from our old address, which includes a CCJ for non-payment of tuition fees. This was issued on Thursday. The claim form was sent on the 11th.

If we had got it, we would have obviously fought it, as she had a student loan to cover. What can we do?

The course says that if they withdraw before 1st december then she is laible, however, the Uni removed her in Febuary.

if you think that you have a good chance of succeeding if you are allowed to defend the claim, then you should apply for a set aside immediately.

Put the application in as soon as possible. Search the forum for the word: set aside and read up about it.

A good County Court claims guide will help you a lot. We advertise one here by Patricia Pearl

CCJ may get set aside if you apply for it, based on not receiving paperwork.

However, fee loan entitlement goes on the date of last attendance, not the date at which the university withdraw the student. With that in mind, could be that they were not eligible, as criteria for eligibility for a fee loan is that they are in attendance 3 months after the first day of the academic year.
