A little bit of help / information would be welcome if any. Thanks in advance

 

 

Briefly: Company – Vodafone – 18 Month Contract

After 4 months, split with partner, left in serious debt (about £60k)

Phone returned to Vodafone + explanation and minimal offer

Vodafone keep phone and no response

Passed to CrapQuest – Letter DEMANDING payment

Letter + copy of Vodafone letter to CrapQuest

Rejected by CrapQuest

Letter to Crapquest requesting Statement, Letter of Assignment, T & C’s

Letter from CrapQuest stating they did not require a Letter of Assignment, statement just a total on a pice of paper

In meantime CrapQuest pass Debt to Scotballs

Email to Scotballs telling them account in query. Get apology and a/c returned to CrapQuest

Letter from CrapQuest offering 50% discount if paid immediately – Have they purchased debt

As no Letter Of Assigment arrive requested CrapQuest to desease processing my data

No response – Letter to CrapQuest indicating I would take legal action under the DPA

Debt passed to Fredprickson Demanding payment or they will go to court

 

As Fredprickson are not the account holder I know that any action will need Vodafone on it. My question is as this has been passed all over the place between mugs and thugs and with no letter of assignment and therefore breaching the Data Protection Act, not forgetting the offer of a 50% discount from CrapQuest, when / if this goes legal where do I stand as I no longer have the phone (can I request this back) as I would not have had the full benefit fromthe phone. I am not trying to dodge the debt but get a fair result

Can you clarify? I would imagine CQ have soemsort of formal arrangement with VF to handle debt. Would they necessarily need an individual letter for each account? Presumably it could be done in bulk so they would still have permission from VF even if they didn't have an actual invidiual letter.

Let me put it this way, if I sent you a letter with just "You Owe £500" would you pay me. Of course not.

If they are after the lot (around £600) then the phone back unlocked so I could go PAYG.

 

I am in very serious debt and a DMC has taken on my debts (this before I knew about this contract) and I have been squeezed to almost the limit so it would be a minimal payment.

 

If I did not get the phone back then the bill to the time Vodafone terminated the contract themselves (about £180)

 

I have never given Vodafone express permission to either transmit or send my data in any form to a third party (no mention of such in T&C's), that needs to be corrected.

 

I have never received a default notice (No one can prove it has been sent either, again against rules as it should be sent by recorded delivery) therefore any default removed from my Credit file

 

BUT .. also, this account has been passed between all the DCA's mentioned whilst this was under query .. definately NOT allowed .. and therefore in breach of the DPA

 

Apart from that nil as I will be leaving the UK and certainly do not wish to use Vodafone in SE Asia

Yo had the same problem, Lee from Vodafone sorted it out for me. Give him a nudge. Nice to deal with a OC team instead of DCA. Excellent service as well.

Bryan 'bloody' Carter is an extremely irritating excuse for a solicitor, quite how he is still working as one I'll never know.

 

Get in touch with the Legal Ombudsman and make a formal complaint about him, the sooner he is disbarred the better.

I have received a reply from Bryan Carter (Solicitors) today stating that they are no longer acting on behalf of Vodafone, howeever, I will resend the email later this evening but what do you require from me ... contact details (phone / email) unable to find / remember the account / phone number but have the CrapQuest reference

Bryan 'bloody' Carter at his very best! Why oh why do companies allow their name to be dragged into the gutter by using such a pathetic outfit such as these? Could it be the No win No fee? Or just that these clown outfits are the cheapest and are indicative of the customer service you should expect from big corporations!

Is there anyone who is not associated with Vodafone or Vodafone Associated companies who may be able to give me some advice on two emails. I am unable to post them on the forum as I do not wish for prying Vodafone eyes to read the contents as I am anticipating this will go to court and obviously do not wish for any advance warnings issued to vodafone of the content.

Seriously IMO it is far better to be dealing with the OC than it is for any third party DCA they choose to use.

 

You just need to bear with it, if Voda wanted to go to court over this, then they would have done so long before now, and most certainly they wouldn't have employed such incompetent DCA's to chase you.

 

The majority of letters you receive from DCA's are computer generated, and the only human input they will have had is from the postman pushing it through your letter box.

 

I would strongly urge you to give Lee some more time and another chance in dealing with this for you.

I'm sorry that you feel that the only way of getting this resolved would be to escalate matters through the courts and of course I'd disagree with you here.
