Now qq/mackenzie hall going for a ccj!!

Hi all

My longterm battle with payday loans continues,

 

today i have recieved a letter from mackenzie hall dated 21st april,

 

they sa ify i dont pay they are going for a county court judgement!! yipee i think another one !!

 

They forced me into an arrangement OF £50 but i cannot afford it,

they wont take no for an answer,

 

ive checked my credit file and they have already issued a default

,im at my wits end,

yesterday had a call from the banks fraud team,

money has gone out of my account and they have tried to take more,

my cards been cancelled

,im getting hassles from moorcroft who i have an arrangement

and wescot who keep threatening to come round!!

I nreally am at my wits end

 

,im going away at the weekend and scared somebody will break into my house from one of these dca,s whilst im away

(my husbands paid for this holiday and its a well deserved break as ive been ill

and had a lot of personal trauma recently-just in case anyones wondering why im going away when in debt)

 

What do i do? im paying at present what i can afford but nobodys listening

and im getting ccj,s all over the place-

please help im so stressed

,i really feel its tipping me over the edge x

Report Mackenzie Hall to Alan Stewart at East Ayrshire Trading Standards and to the Office of Fair Trading.

 

They have very little grounds to issue a CCJ, and if they do it can easily be defended, if you have been trying to negotiate keep EVEYRTHING in WRITING, stay off the phone as they twist things to suit their needs.

 

They CANNOT break into your house without a court order and you are a long long way off that yet, that threat alone is worth reporting them.

 

They CANNOT send anyone round to 'assess your assets, demand payment or contact any employer past or present for your details'.

 

Mackenzie Hall have very few powers and cannot do very much.

 

Who else is threatening you and how are you 'getting CCJs all over the place', if this is the case you can get a court administration order which will take a minimal amount for each debt from you.

Thanks for your reply,i have a ccj with tower capital but have paid it off now,i also have one for capital one with bryan carter,still paying that.Im being threatened by wescot re welcome finance debt,they forced me into paying more than i can afford,made one payment but cant keep it up,they want £89, i offered £25 but they constntly ring,there threatening coming around and they want ie asnd wage details of my husband,im also having similar problems with moorcroft despite them coming to an arrangement,they just keep asking for more and threatening to come round,just sick of it all,everyone else have come to arrangements its just mostly these 3!!!

Wish i never got involved its a vicious circle and anyone reading this thinking about borrowing money from these people PLEASE DONT!!! its made me ill and not sure how much more i can take. x

This is how they work. Sillygirl is right, they have very little power over you. You can't give them what you havnt got and any court will support this. If they don't accept reasonable offers tell them to take you to court and let judge decide. They will not break in so don't worry about that.

Plus to add to the above with mucky hall its mainly just hot air with them. I got a letter saying they were (no maybees or words like that) taking me to court, this was 6 months ago still waiting for my court papers........

no dca has any legals powers

 

your list of debts and whose collecting on them

and the stories you are telling ring a few alarm bells with me

 

you REALLY need to have a good read of seq's blog in my sig

and get cca's fired off to everyone you are paying

 

as for the payments its YOUR MONEY

 

TAKE CONTROL dont let them do it.

 

TELL them what they are going to get and pay it by internet banking

 

dont use DD's or give them card numbers either.

 

i have a feeling you are a cash cow here and they have you as a soft touch - start fighting back

 

also your need to get reclaiming

i bet you 've got heeps of charges [esp with welcome]

now ive added blank lines and sentence to your OP and i can read it properly

i can see your got a few misconceptions about these leeches

 

 

firstly THEY ARE NOT BAILIFF THEY CANNOT BREAK INTO YOUR HOME

 

even the ones that have got a CCJ, - cannot send bailffs around to break in - these are CIVIL DEBTS

the only time a bailff can force entry are on CRIMINAL FINES.

 

i also suspect a lot of these CCJ's can be set aside

 

you need to start a thread in the named forum for each one and tell your stories
