  1. Ahh, yes i did add this into my original complaint back in June and it was upheld. No worries though i will just have to pay and live with the bad credit for a little longer. To me it is strange though as hypothetically if i never pay them they could report the loan as "late payment" till the day i die, what just does not sound right at all. I trust you word though as you are a very experienced poster. Thanks again for taking the time to reply. If anyone else has any magical ideas please do let me know. Thanks all

  3. Thanks so much for your reply- I may have misunderstood the process then. From the ICO website it says- Generally by the time the account is 3 months in arrears, the lender may be taking further action such as reporting the account as defaulted (see Principle 4 below). Missed payments may continue to rise and be reported up to a maximum of 6. On some products this may continue to show as 6 until the lender takes action and reports the account as being in default. The exceptions are- There are exceptions to this which may result in a default being recorded at a later stage, such as secured or long term loans e.g. mortgages, or if the product operates in a more flexible way e.g. current accounts, student loans, home credit. http://www.scoronline.co.uk/sites/default/files/high_level_prinicples_document_final.pdf Any advice on that?   4. Hi a bit of advice needed I had a payday loan with Next Credit. This loan was taken out in early 2013. Unfortunately due to serious debt issues I was unable to pay. Moving forward to 2016, I checked my credit file and Next credit had been reporting the loan as “late payment” for 3 years, no default. I made a complaint with them regarding this and they sent a final response in June 2016 saying “your credit file is a true reflection of the status of the loan”. I was going to raise this with the ombudsman but to be honest I forgot. I want to get this sorted I am happy to pay the balance (what currently is 2.8 times the loan amount) but I feel 3.5 years of late payment markers is unfair. If I pay this now it would be a further 6 years until this falls of my credit report. My question is what can I do, I understand I am out of time to complain to the FOS. I did make a complaint to the information commissioner's office, 4 months ago but I have not heard anything (I have chased this up and they keep saying they are busy) Is there any other options, could I file a county court claim maybe? If I can what would I file it under- i.e- mishandling of personal data? Any advice would be greatly appreciated.

  6. apparently according to various news reports, 15 lenders heave left the payday market ahead of the oft/fsa deadline to sort out there business practices. Does anyone know what ones have closed up shop?
  7. just give them a call i am sure they will refund the over payment, you have the agreement in writing after all, so if they don't ask your bank for a charge back. I am sure they will refund though as they seemed easy to deal with when i had a plan with them.
  8. Sorry for the late reply. there have been payments taken from my account yesterday for pay day loans. The problem is the bank say it has not cleared yet so I have to wait a few days as they can not see who took the payments.
  9. I have had some unauthorized payments leave my account and Lloyds tell me that , the payments have to clear before they can put a charge back in place. Does anyone know if that’s correct or am I being fobbed off?
  10. Inore them it will become statue barred in one year anyway, and then you dont have to pay by law.
  11. Yeah I am sure that your right, and they are “probably” ok to use, but in this day and age any company asking for online banking details must be mad.
  12. Hi all, I have looked through the cag library and can’t find a letter to meet my situation. I have requested a cca from Barclaycard and they have sent a reconstituted copy with no signature etc. They have acknowledged it is a reconstituted copy so what now, as the template on cag is for when the creditor sends a actual copy. This account is from 2002 if that’s any help. Thanks in advance.

  14. I am the claiment, I work for a rather large insurance firm so I was shocked to hear they never responed, hopefully the e.t will make it a strait forward process as the size of the claim is not big. Thats unless they come out with some waffle about why they never sent the et3 back
  15. It meant "original poster" lol My et3 form was supposed to be received by the ET 2 days ago and they have not got anything, and I can be sure they got it. I think the best thing to do would be wait till the beggining or next week and call them again and ask about a default judgement. Is it a complicated process of fairly strait forward? (if you dont mind responding)

  17. Bump. Speedy cah are a fairly new company so it is likely that there is knowone who has delt with them. If you could let us know what they are like it would be good for anyone in your position in the future.

  19. Yeah mate they might take you to court they all have form. But why are you worried if you are planning to ignore them...... At the end of the day we dont support avoiding debt here. If you are on a low income there are still options avalible to you to pay them back.If you are interested let me know and i and other guys can advise, If not well keep burying that head of yours.
  20. Thanks dude, i asked as ndr colleting for quick quid called me today on a mobile i have never given anyone except speed cash, so i was baffled how they obtained the number (its a payg phone), i guess they got it else were. Thanks again.
