No need to send anything to the court. If they defend you will get an allocation questionnaire to fill in and once it has been allocated they will set a timetable for exchange of documents.

Just been thinking about IGroup, if they reply to the summons will they send something to me or will the court inform me they have replied and what they say? I keep coming home everyday expecting a nasty letter but nothing as yet, they have until 4th November!

Still no word, expecting them to leave it until the last minute but I've just had some junk mail from them asking if I remember taking out an IGroup mortgage and how delighted they would be to welcome me back, that put a big smile on my face - not on your nelly matey LOL

I'm back again, well the time to ackonwledge the claim runs out tomorrow, as its a Saturday I'm going to be kind and let them have until Monday, it seems to me from reading other threads that even if they miss the deadline and I get a default judgement against them it makes no difference if they contact the court at a later date, seems pretty pointless. Given that I was thinking of just leaving it another week or so to save myself the bother of getting all excited only to be brought back down to earth.

 

Any thoughts?

Bu**ar, they acknowledged today, I thought it was too good to be true, they are obviously playing the game of lets draw this out as long as possible, date til defence has to be filed is around 4th of December then.....

 

Is anyone in front of me with IGroup?

Hi Sammy, I'm in front of you on this. AQ was due to be filed on Friday 3rd. I filed mine but GE Money's new solicitors hadn't filed theirs when I went to Court on the Friday. Got letter on Saturday from Eversheds, GE's new solicitors who have taken over the case from the old firm. They sent me copy of their AQ and had requested a Stay of 1 month to attempt to negotiate. I wrote to Court (and emailed Eversheds) to say I didn't think there was little point in a Stay as this matter had been going on for 3 months and they had not been prepared to negotiate. (See my thread GE's Slrs request Stay). Headnothing so far. Good Luck. I'll keep you posted what happens, if anything.

Sounds good for us that they want to negotiate or like you imply in your note to judge maybe its a ploy to keep the money in the bank longer - LOL

 

I got the paperwork for the acknowledgement today, completed from the legal officer in GE money, they obviously haven't passed it on to Eversheds yet.

Well after hearing about Dogwash's judge decision not to allow the stay I thought it was time I updated following the letter I received on Saturday, only 7 weeks after first letter was sent! I'm sure its the usual fob off letter but I've posted an extract below just to be sure and to give you all a laugh, any comments gratefully received. Of course it also told me they had enclosed a terms and conditions and a mortgage information booklet which they didn't!

 

"Early repayment charges are designed to help us recover the costs of customers settling early. These costs include:

 

The cost of specialist resources we use to set up our loans and assess our risks.

 

Our admin expenses in maintaining your account

 

Our funding costs.

 

The commissions paid to intermediaries on loans which we complete because a) the specialist loans we make involve intermediaries carrying out more work than normal (example to satisfy our need you can meet your payment obligations) and b) a high percentage of loan applications do not result in loans being made, so the broker will receive no commission on these even if he has done all the work.

 

An element of our loss of profits caused by you repaying your loan early"

 

I had to laugh especially at the special resources bit and the checking I can meet my payment obligations - they must do a roaring trade in crystal balls!!! Especially given I was in a DMP at the time - I'd be interested in the % of people they turn down. They really shouldn't have bothered because they have just added fuel to the fire, I'm raring to go now!!!

Well, yesterday I received a letter from Eversheds telling me they are representing Igroup, then today I received their defence! I was quite shocked really, they only acknowledged on the 6th, anyway I tried to go into MCOL but it doesn't seem I can do any more on there so time to wait until the court send through my Allocation Questionnaire, the defence doesn't say anything interesting, in fact its a photocopied sheet and they call me a he!!!

Just another update and some advice (hopefully)

 

Are GE Money for real!

 

I have recieved a letter from GE Money today - and get this - they have sent me the N1 form that I handed to the Court along with what they are supposed to send to the Court if they are defending or admitting the claim! Their letter reads:

 

Loan secured on XXX (this should be the old address as we are claiming the ERC from that property, but they have our current address)

 

Further to your recent communication

 

Please find your documents enclosed

 

If you are unsure as to any of the contents of this letter, please do not hesitate to contact us.

 

Yours Sincerely

 

GE Money

 

What do I do now? If they do not acknowledge the claim, do I win by default? Should I go to my Court and advise them that they have sent me these documents? or send the it back to GE Money (I really do not want to do this, as this is their incompetence)

 

I do not want to jeopardise my claim.

 

Any advice would be greatly appreciated.

It was just surprising, out of all my claims no one has actually sent me the original N1 form that I typed, signed and watched the Court clerk stamp.

 

Lets wait for the judgement, if they do not do anything!

Well, it was pay day yesterday so I finally paid my court fee and handed in my Allocation questionnaire, not a word from Eversheds but if they are true to form then like Dogwash I will get a call soon!! Not sure what happens next court wise, guess Iwill get a date and be requested to lodge my evidence....

A word of warning Sam, if you get a call it will probably be "Without Prejudice" - you can't produce it or refer to it in court, so it won't mean a blooming thing. My two calls from Gareth Vowels were both "without prejudice" - first call to negotiate, second call to confirm his clients agreed to my offer and then not heard anything from him for over 2 weeks, he just ignored my emails and phone calls and most importantly haven't been paid. Gareth Vowels and GE have been so unprofessional I am reporting GE to FSA and him to Law Society for basically messing me about - more eloquently phrased as I will making a complaint about professional conduct, or lack thereof, and general handling of the case. So I am now going for full amount plus interest and wouldn't be surprised if it has to go all the way to court. My advice would be to say you are not prepared to enter into any communication with him on a without prejudice basis, either by phone or by letter. Get it all done by letter with no without prejudice attached so at least you can use it in court if it gets to that.

Thanks Sue, I've had dealings with Eversheds before unfortunately and I think you are right, ti makes me even more determined to get GE though, I couldn't give a toss if they read this site personally, maybe it will make them understand how determined we are, I shall not be speaking to them on the phone anyway so they'll have to send me a without prejudice letter!

 

I'm still keeping my fingers corssed for you, I think they are just playing hard to get!

GE Money filed an Acknowledgement of service on the 23rd November 2006. Their Soliciters filed the acknowledgement, your friends and mine, the great 'Eversheds'.

When they say 'without prejudice' it only binds people in the legal profession. Joe public can refer to whatever he wants, he is not breaking the legal equivalent of the hippocratic oath by doing so. I have problem with GE Money also but am starting new thread about it.
