Posted my claim into Capital One.

 

Capital One: £260.00 Letter sent 25.03.06.

Hi,

 

Got a response letter from Capital One yesterday (5.4.06). They kindly explained to me the circumstances under which they feel they are justified in levying a charge on my account (Arrogant B*****ds). Anyway, they offered me only 1 Overlimit fee and 1 Late payment fee and said that these had been returned to my account.

 

The shame here is that their letter arrived 1 day after the deadline set by me. On the same day they should have received Court Papers issued on 4.4.06!

As people on here rightly say, 'My Timetable, My Way'.

 

They stated in the letter that should I need to contact them then I should write back to him (Robert Udy) so, of course, I will be calling him on the telephone this morning!

 

What I'm not sure of at the moment is whether I need to inform the court that they have made, and I have accepted, a part payment of £40.00. Does anyone know the procedure?

 

I will be posting the court details as soon as I have a case no.

I'm not a legal person, but I think if you accept their offer ( cash a cheque etc), then you have accepted that as full and final. I would have returned it with the subsquent letter, rather than be deemed as to have accepted their nominal offer.

The £40 in question was refunded directly onto my credit card account. I didn't, and wouldn't of, cashed a cheque.

I believe legally that I can accept this as part payment without jeopodising my claim in any way (except £40.00 less of course) as I have not been asked to sign any waiver.

I have also informed the court that this payment has been made and under what circumstances.

So we shall wait and see!

Hi All,

 

Ha Ha. Yesterday I got a nice letter from Cap One offering me full settlement.

I am accepting of course.

I made a slight error on the paperwork into court, I forgot to add the 8% to the claim total. But the nice people at Capital One calculated this for me and included it in the settlement figure!!!!

 

They have sent me a complaint settlement form in which they refer to the moneys claimed as "Penalty Fees" which I thought was good of them to admit.

They also want this settlement to remain confidential which I have agreed to.

Thats what they think! They can sue me for breach if they wish!

 

Anyway, onwards and upwards. Just another 3 claims to go.

 

Stick to your guns and you will get your money.

That's great news! Well done. I have had an acknowledgement that they are dealing with my request for details of all charges levied on my account since it was opened (less than 6 years)....just waiting to see what it amounts to. Will keep you all posted.
