As I am in the middle of all this payday loan mess (I have 10)

 

I could not afford to pay them all back. So I wrote to all my creditors with an attachment of my expenditures and letter from CCCS Debt remedy to offer a payment plan but this is the reply I got from Toothfairy after offering 10/ month which is realistically what I can only afford right now as I am paying all 10 creditors in payment plan as well!! Any advice what I can reply to them?

Im going through same issues as you!

 

Any chance you can list all your 10 creditors may help us to advise you on who to deal with first and what there like to deal with.

 

Also with regards to toothfairy do you have any money in your account tonight could you make a token payment to them tomorrow of like £20 - £30 that shows your facing up to the debt and trying to pay it and possibly just to avoid extra costs from bailiffs could you not up your offer by £5-£10 a month.

 

From reading on here toothfairy are hard to deal with but i would try and make a token payment as if it did go to court that would be in your favour.

 

Also be worth reporting toothfairy to the office of fair trading as they have had warning before and the more complaints against them the better. attatch a copy of the email with your complaint,

All have been taken out mid 2010 and I have made payments on time for months and months so really I have paid them so much interest already because I have been rolling over from one loan to the other juggling my finances and now I just want it to stop so I cancelled my debit card, wrote to my bank that I revoke all authority for the ff. companies to access my account by any means and now I am in arrears with them for 2 months because I cant not decide what to do. Everytime I make an offer via email or phone they just reject it and want my card details which I am not giving out!

 

I was planning to sign up with a dmp with Debt Advisory Line so they can handle all this for me because its just too much for me to bear. Anybody know if that is a good idea? I have moved out my old address as I was a temporary tenant and now living with relatives so really I dont want their address involved in this so everything is still in my old address. I have no idea what kind of letters they are getting there but my friend has forwarded them all to DAL unopened which I originally plan to sign up with but after reading reviews for DAL, I am not too sure if I should arrange payment plans myself or use them.

 

I was checking the Reviewcentre for Debt Advisory Line reviews almost every night, it currently displays all nice reviews about DAL. But one night I read a very bad comment about someone being with them for 16 months and nothing was set properly but then when I checked again the next morning on the reviewcentre, that review was gone! So now I am having second thoughts with them! maybe theyb have authority to remove all the bad reviews so all we can read are the good ones?

 

So I went on the CCCS website and did the CCCS Debt remedy and followed the instructions on the booklet and sent all emails to my creditors again offering the realistic amount I can afford attaching my expenditure and list of creditors. I will be waiting for their replies by next week. Except for Toothfairy of course who want their reply by 10:00 am tomorrow or they will pass on to Phillips bailiffs.

 

What I need to know is how to deal with TOOTHFAIRY and the rest as well as my balance has now become £984 from originally taking out £300 loan with them and I have been always on time with them before for months paying them with interest, rolling over even if I lost a lot of money. They didnt even consider that they have took so much money from me already thats why I just decided to stop all of this.

 

Can someone please help me? I am having sleepless nights, not functioning well at work and I just want to get out of this mess.

 

I know that Toothfairy is just sending these letters to scare me off but what can I do in order for them to accept my payment offer? Which is what I can afford now really?

Stop right there!

 

Your telling me you took out a loan with toothfairy for £300 and they are now demanding £984.

 

If thats right i would send tem an email something along the lines of

 

With regards to the email i received today from you demanding an arrangment by 10 am tomorrow i have taken some legal advice and i have decided that i will not increase my offer of £10 a month unless you can reduce my balance to a reasonable amount the original loan and 1 months intrest ( nothing more, you may have to keep fighting) if you are not prepared to do this then i would appreciate if you could file a claim through the county courts so that a judge can decide weather or not the £684 worth of charges on my account are legal and justified.

 

Tell them you want to go to court, i cant see toothfairy taking you to court and in the end they will give in as long as you stick to your guns. If toothfairy do agree to drop the amount to £300 and 1 months interest i would try and pay it over 6 months nothing more. so it would be about £60 a month.

 

Also put in you email that you are aware that NorthernDebt Recovery are based in same building as toothfairy finance and they are there inhouse debt collectors! very sketchy i know!

 

Have you requested a breakdown of charges of the fools????

 

just to pre warn you cash genie and capital finance one are horrible to deal with so beware just stick to your guns and dont let them pressure you. Also Quickquid will not accept any payment plan unless it 3 months or under so your best waititng till they pass the debt to debt collection agency mcenzie hall and they will accept anything reasonable.

 

Make sure you email toothfairy asap asking for break down of charges, stating you only prepared to pay original loan and 1 months intrest if they dont agree then tell them well take me to court as id like to see you justify you hideous charges to a judge

Do not communicate with these jokers. They have already been warned about this type of behaviour. I borrowed £100 from them once and one day they turned round asking for £867..........

They will NOT be sending baliffs or obtaining a CCJ or sending anyone around to your home so don't worry.

Track down the older TFF posts they might have some info that will help you.

 

If you have sought advice and £10 is what you can afford, then that is what you tell them. In fact, go ahead and start paying it until you have paid the £300 back you borrowed. They will cut their losses and forget their interest.

I've checked my credit file with all 3 CRAs and this crew of idiots has never appeared.

Geez, and I thought MiniCredit were bad, this mob seem worse!!!

 

Most of the others should accept a payment plan no prolem with PayDayUK poorbably being the easier, they are a good bunch of folk at collections.

The Toothfairy finance website clearly spells out their agreement, and that they add charges (legal and recovery fees)... why are we complaining that they want their debtors to stick to their end of the bargain, and so quick to trip them up on small minor errors?????????????????

If you dont pay they will turn that last £150 into a silly amount and it will end up getting your credit record ruined.

If it goes to court they CANNOT use bailiffs before.... they have been in trouble with the Office of Fair Trading for not behaving nicely so report that email to them and report it to Trading Standards via Consumerdirect.

 

Golden rules for dealing with PDL companies are

 

1. Change to a basic bank account with Halifax or the Co-op to protect your income - do NOT let this bank account out to anyone other than basic utility companies.

2. Keep everything in email, email daily if necessary, even if they telephone keep it in email.

3. If they threaten attachment of earnings or arrestment of bank accounts report them to the OFT and Trading Standards

4. If they send court papers check that they are properly stamped - there have been cases of them printing stuff and telling people they have CCJs when they dont

if this happens get onto the OFT and Trading Standards and the Police as it is FRAUD

5 If they empty your bank account complain complain complain in writing and go into the bank branch and claim hardishp, take the original contract with you and demand to see somebody senior.

Because they are NOT minor errors, their charges are crazy and go against the OFT guidelines on debt collection. If it was the odd £25 fair enough but to turn a £100 loan into £800+ is madness, if somebody can't pay back £100 how on earth are they going to pay back £800+.... and if they are made bankrupt they CANNOT 'opt out' of the bankruptcy and chase them after annulment.

Today I have ended my payment plan with toothfairy. Borrowed £300 in September and repaid £450 over 4 months. As soon as I set up the plan I had an e-mail from NDR telling me of the dates agreed. If anyone is finding it hard to deal with toothfairy It may be an idea to bypass them and call NDR direct…. Just a thought

Firstly do not panic !! These numbnuts will try to bully you into paying a chunk of this or a chunk of that, not caring about other priority bills..as somebody else stated mortgage/rent and utilities first out of your account...

I had a quickquid loan about £200 left to pay , racked up charges took balance to £390 refused to negotiate a payment plan,threatend court etc etc in the end passed to Clarity who were decent for a DCA..in the end proved all charges so refused to pay that and offered a full and final payment of £100..clarity excepted in writing and updated credit file.

Personally I would write again offering £10 and also not to increase further charges...keep ALL correspondence if it does go to court which I would be surprised a judge will be pretty peed off with these companies for not assisting also the interest charges will be sky high whihc wont look good...

These companies and DCA's cant just send baliffs around as they please, it has to go through a court which will cost them as a start..

Get ready to fight these planks , somewhere on these forums is a great form highlighting responsible collecting procedures and these companies are certainly breaking the rules with threats and non cooperation...

They trade on peoples fear and lack of knowledge !!!! Telling somebody they are sending baliffs is WRONG and illegal , stacking charges on top is pointless as the person cannot afford the current balance.As the orignal poster pointed out he HAS been paying but has hit financial difficulties , these companies know this who else goes for a short term loan ??

This guy is telling them this and offering payment albeit reduced...their replies say it all..so imho SCREW EM....

Thats what I did and still do with my current DCA's...my terms my conditions...when they sense people have knowledge they back off....

lol..nice post and to the point !! Personally if people want to come on here and sing the praises of particular companies so be it..the issues are when people get into difficulty and are just asking for a little help or at least common sense from a lender instead having to put up with pathetic letters lying about court action and baliffs in big bold letters to get the point across, oh and for good measure whacking on charges which would shame a loan shark...!! I hope the OP has managed to get a grasp on these payday sharks !!

i'm sure that for the majority of people payday loans are great.

 

but this forum is for people who have had problems, are being harrassed, have been overcharged and many other problems can discuss their issue and get help.

 

its not a place for the lenders to come too telling people how wonderful they are.
