OK,

Both accounts where charged a £30 default notice fee yesterday.

This morning I have received a letter from the Birmingham Collections centre.

 

Apologising for any dissatification caused by charges and we believe that our charges are fair, reasonable and transparent. The OFT are in contact with us to discuss the level of charges on credit cards.

 

 

So the standard sod off letter.

I will gladly donate 5% of reclaimed charges to CAG!

Update,

 

 

Last week I sent a letter to the Lending Centre saying that the accounts are in dispute please hold off. Still no response.

 

I also sent the follow up to the DPA request,they have until Saturday to reply.

 

I also just received a letter saying that my student account is being updated to a graduate account. I thought the default meant my account was closed.

 

I'm sending the LBA on Friday.

 

I'll update soon.

The forty days pasted and I had only received banks statements so I the sent them the follow letter giving them seven days to send me the rest.

 

The seven days ended on Saturday and now it's Monday still nothing.

 

Has anyone got a full DPA from Natwest?

i had a similar problem on my thread, but it seems that NatWest hardly ever record manual intervention, so the statements are about all you're gonna get from them. http://www.consumeractiongroup.co.uk/forum/showthread.php?t=6505

24-08-06 - AQ received and returned - Deadline 08-09-06 - Both returned

20-09-06 - 1st Offer - £850.00 with confidentiality REJECTED

05-10-06 - 2nd Offer - £1456.80 with confidentiality ACCEPTED

Great News today. :)

 

I received a letter back from the Lending centre saying that sorry I was unhappy please except £3** gesture of goodwill. Which includes a £30 default fee, so i'm not sure if that means the default has been taking off of that account or not, but there is still a defauft on my student account.

 

I also received a letter back from the Data Protection Act department saying that I didn't request a full SAR - (Subject Access Request) only bank statements.

 

The letter I sent was the DPA request in the Library which clearly states I want everything.

 

I've just checked my account and they have already put the £3** in there. The £** only just puts me back in my agreed limit.

 

So i'll be sending two letters tomorrow one saying I will except the offer as part payment and the other will be the LBA.

So i'm still fighting to get a full Data Protection Act. The statements they sent me had several months missing. Foolishly I have been responding to their letters but I have sent the LBA DPA today giving them seven days to comply.

 

 

I sent the MP libary template letter to my local MP a couple of months ago and today I got a response back.

 

She is pretty much on the fence about the charges but does understand and has past the letter to the Secretary of State for Trade and Industry, Alistair Darling MP.

I will gladly donate 5% of reclaimed charges to CAG!

I still don't have my statements. I've sent them the LBA DPA letter twice and they keep saying the statements have been ordered and will be with me soon. aahhhh! I know they owe me just under £2000 but there is two - three months of missing statements I want. So it's been about 2 -3 months since I first ordered my statements.

Natwest are closing my mothers Credit Card account and will not give her a reason why. She has always been in the agreed limit and pays money into the account every month.

 

Could the reason be becuase I am taken them to court over my accounts?

 

Any ideas?

Get her to ring them to ask why they are cancelling her account, it may be that they think she is you! wouldn't be the first time they got things wrong! Besides that even if it were your c/c they shouldn't close that account anyway as its a separate agreement!

Nat West did exacty the same to me - when I queried it as I just put money calim for bank account was told it was a fair assumption that it was being canceled because of other claims against bank.

I sent them the LBA and on the 14th day I got a response offering £600 as a full and final payment.

 

Which I'm not going to except.

 

I'm gong to fill in the money claim form tomorrow and take it down to my local court.

 

The thing i'm not sure about though is they have already ready put about £400 into my bank account when I first sent the preliminary letter asking for repayment. I sent them a letter saying I will except it as a part payment but I will still carry on for the full amount.

 

I never got a response back, just a response when I sent them the LBA.

 

My question is should I exclude the £400 from the full amount I will be asking for tomorrow?

Yes you have to take that off. Have you used the spreadsheet and calculated your 8% interest?

 

If you have, take off the most recent charges that total £400.

Claimant has account (A/C No) with Defendant from 2001 conducted on their standard terms and conditions. Claimant is claiming the return of money taken by Defendant in charges over 6 years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e.

In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from 2001 to 2006.

Do I need to include the amount I am claiming in the particulars?
