One of the more recent and frequent areas of discussion has been the idea that creditors can send reconstituted versions of agreements in response to CCA requests. Indeed they can. But how does anyone know that what the creditor sent is indeed a 'true' copy of their original agreement?

 

I've recently been sent one of these reconstituted agreements from Halifax but I had already been sent one a couple of years ago and the two documents differ. It is only a minor difference admittedly but a difference it is. This means that one of the reconstituted versions is not a 'true copy' of the original and for all I know, neither is.

 

Is it about time that we had on this site a document library where we could collate copies of agreements and terms and conditions from the various lenders from over the years? I'm quite sure that enough people have original copies that could be posted up so that we could all compare what has been sent as a 'reconstituted' agreement to what it should have actually been. There are quite probably thousands of these already posted on the site.

 

I'm personally willing to do my share of the work in collating this and putting it into some kind of format that would be usable and useful but I couldn't do it on my own - this would have to be a concerted effort.

 

If I'm talking crap then tell me, but I think there could be some mileage in this and I think the force behind it should come from 'on high'.

Sounds like a 'sound' idea, after all, each OC can only have a limited number of Agreement 'styles' per year, whilst we know that Terms and Conditions change quickly at the drop of a hat.

 

The only downside I can see, is that we could actually be helping the lowlifes in that they will only have to go to our templates to see what your agreement should have looked like and take it from there if you get my meaning.

 

A Good idea in theory, but think it would need to have 'specialised' access only.

I see your point, but they could do that anyway by looking through the threads where these have been posted. As you say, it would need to controlled somehow. But this has to be looked at. The banks seem to think now that they can print any old garbage and that will be sufficient and this would be one way of fighting back against that.

Reconstructed agreements are just a cop out for these cediters. I my own case when I've sent for a CCA I aways add the following paragraph to the CCA letter, that way they know exactly what they are dealing with. I usually have it in red.

 

I am aware that under consumer credit regulations you may be allowed to provide an unsigned copy or a reconstructed copy. Please note that for legal reasons I will accept nothing less than a copy of the original signed agreement complete with original terms and conditions. In the event of you supplying anything short of this I will enter in no further discussion of this alleged debt, nor will any payment be forthcoming.

Trouble is that unless you're making the demand as part of a CPR request, you have about as much legal right to demand that as the lowlife DCA's do to make all their silly threats.....
