My husband bought a petrol mower on Ebay in February on a Buy it Now price of £82.00 plus £12.00 shipping from an Ebay business seller.

Delivery was promised in 48 hours by courier and after countless emails it finally arrived 10 days later.

The mower was a piece of scrap, totally rusted, filthy, full of old grass cuttings, covered in leaked oil with the leaf bag rotted a full of holes. It was totally unusable.

We requested a return with full refund as the item did not meet the description. The seller agreed and after many more emails it was finally collected 6 weeks later.

He now has the mower plus our £94.00 even after three weeks has not issued the refund.

Ebay will do nothing for us as it has past the 45 day deadline, (only because the seller stalled constantly)

Has anyone got any suggestions where to go next with this, I may be just seeing red mist but this has got to be theft, pure and simple?

How did you pay ?. Ebay has limited power to refund/sort anything out, most disputes are sorted via paypal, normally paypal will refund you and then chase the seller for the money.

 

If you didnt use paypal then as suggested send a LBA and if not response start a court claim, its easy using the online system.

We paid by Paypal.

When we tried to complain through Paypal, the site just referred us back to Ebay.

It seems because it is past the 45 day limit nobody is interested. And, it wouldn't be past the 45 day limit if the seller hadn't messed us around so much.:evil:

how is you PP paid though if its a CC do a chargeback.

Why? PP is a processor, not the seller - so not only do you breach their T&Cs (assuming your bank mistakenly agrees) you end your reationship with PP totally.

 

For info - chargebacks can only be actioned where the funds are taken by seller or agent, NOT an intermediate bank.

well i've done that three times and paypal never agrues

think its in their new T&C about it saying they must honour it so words to that effect.

That'll be good if they've changed their stance. The Barclays and Lloyds TSB ordinarily always refuse for this reason (the seller dispute has nothing to do with the payment processor, so take it up with them). The 45 days limit is still pretty short, it should be 60 at least.

You don't 'file' for one. You simply tell your card issuing company you don't have the goods and you want the patment refunded, as the vendor has not refunded you as promised.
