Have missed one payment with citi and they have charged me £12.00 they call this a late payment fee.

 

I have also noticed that they state in small print the following:-

Your promotional interest rates have been removed because your account has not been maintained according to your terms and conditions.

 

Also on the statement it says that Esimated Interest £275.06

on all prev statements my estimated interest has been between £60 - £65.00.

 

This leap in interest rate would be humongus :-xthey do not state the increased rate of interest though:confused:.

 

I am really worried can any body help to shed light on this please?

 

Can I claim the £12.00 back for the late payment fee?

Yes you can claim the amount back, aslo write to them and demand to know what interest rate they are now trying to apply, they cant just increase the rate without informing people.

There is a simple temp to request the charges but with Citi not much is simple.

 

Under the Consumer Credit Act you are entitled to account info and I would seek answers to the interest question this way.

 

Ask them for a full statement.

A breakdown of any fees/interest

An explanation of interest in intelligible form

A copy of their complaints procedure.

well SOS looks like you are in the same boat as me. I requested a copy of the cca and the cheque was cashed in March and guess what no cca copy. I am taking the issue up with the FOS.

It is my belief that it is a catch; soon as you are either late or miss a payment they remove your promotional rate and place you on their standard variable rate. They quote the standard variable at about 17% but I reckon if you are the same as me you will be paying 34.9%.

I cannot see how they can justify this. I have writte to CITI but they have not had the courtesy to reply.

It is a money maker for them. Out of interest when did you take out the promotional offer.

Mine was March 08 and I got defaulted oct 08 and have been stuffed ever since.

CITI somehow need to be put into place.

Please also indicate whether there has been any manual activity associated with processing any breach,and give details if this was the case.

I am aware that in the OFT investigation into Credit Card charges in 2006,a fee of £12 was agreed as acceptable between a number of Credit Card issuers and the OFT,however the OFT did state that only a Court could rule as to whether a fee of £12 was fair and reasonable.

 

My calculations are that between XXX and XXX you levied XXX charges against my account.

 

I am prepared to file a County Court claim for recovery of these charges under common law,should you refuse to refund them

 

This is a preliminary request,before a letter before action.
