      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have a CITI card with a very large balance on it and have never missed a payment until this month when I sent a cheque and it never cleared due to me not being paid by a company i contract too.My question is I need to write to CITI and explain I cant pay at the moment any ideas how to word this and should I send a token payment.I intend to CCA CITI as I am sure they wont have an agreement but I need to sort this month first.Thanks.

I sent a CCa request to CITI and received nothing so I did an SAR request I have received that today no CCA enclosed or terms and conditions and a paragraph that says unfortunately we have been unable to locate the application form for you under the account number given so it seems they cany find the CCA any ideas what I should do next?

Strangely (or not) I had the same response from Citi yet the account number I gave them was the only one ever issued by them.

You won't get a copy of your agreement. They will use every trick in the book to get out of sending you it (if they do have one at all)

 

The wouldn't send me any terms and conditions either as they said they weren't part of a SAR. It took the intervention of the FOS to get them and still no agreement.

 

As to what you can do. If you have put the account into dispute there is not much else you can do. If they sell the debt on you can send the DCA packing with a "bemused" letter. If you have stopped paying, they will screw your credit file even though the don't have your written permission (ICO have said it's OK)

I have a file of letters going back and forth with Citi and it tends to confuse them. In one letter they said they had complied and the agreement they had sent was compliant with the regulations. HUH! What agreement??

As for account history. NOTHING. Not even a screenshot.

 

All I ever got directly from them was copies of my statements and copies of recent letters.

 

Bringing it to a close will be hard. No agreement-no pay but your credit file is stuffed. 6 years later, Statute Barred and it falls off your file

All I got was copies of statements and recent letters no screenshot or anything about cca how long have you been fighting them

 

 

SAR sent 4/3/09

reply received asking for proof of id a month later.

various letters sent including a complaints letter

Finally got my SAR on 3/6/06

lots more letters back and forth with a "final response" in 08/09

in this letter they say they were going to forward my T's&C's to Cabot to forward on to me??? (never happened!)

10/09 complained to FOS

Took the till 06/05/10 to get a response. All I got was the T's&C's and the FOS felt that was OK

My last correspondence to Citi was to inform them of my new address and that was May this year.

They are not responding to me anymore.

Just had a letter from the complaints department saying they are looking into why I have not had cca but inthe letter it says that under section 78 request I am not entitled to withhold monthly payments is this correct I have put them in default?

You can then tell them they are talking balls. i would also send a copy of that letter to the OFT. Trying to circumvent UK law indeed. Ruddy American companies

If you're not paying thenI predict they will default you then terminate (without telling you of course). You will then receive a assignment letter and a welcome letter from a DCA (in the same envelope) and both letters will look a similar font. This is because Citi don't issue NOA's.

You will send the DCA a bemused letter who will pass it back to Citi who will pass it on again and you will send the new DCA a bemused letter...........................................

In that case, I'll bet the welcome letter from a DCA won't be far behind. (did you receive a default notice)

 

Citi feel they are above UK law.

They will never admit they don't have one.

 

As I said, when I complained, they said they had supplied me with one and when I wrote back correcting them they stopped replying to me.

i have had a letter from cabot who have bought my account from citi i requested a true copy of my agreement on the 13/10/08 nothing came i then sent them you have failed to comply with my request letter on 3/11/08 still only telephone calls no agreement i then sent them a letter stating no acknowledgement of the debt as they had failed to comply with an reasonably request it went quiet until a letter from citi default notice dated 7/01/09 then a letter dated 6/03/09 termination of agreement nothing morefrom them until last week in the same enevolope a letter from citi photo copy of assignment and the welcome to cabot letter .Cabot have rung every day since sending the letter but i have refused to speak with them .who do i write to them or citi and any ideas what i put any help appreciated thanks

it's to do with the Notice of Assignment.

 

I have received the same as you after Citi refused to sed me a copy of the CCA as requested, even after telling the FOS they had! Consiquently I've been contacted by Cabot and have replied with the following.

 

'

As I have not received any Notice of Assignment of any alleged debt I will forthwith, ignore any attempt by you, or anyone alleging to act on behalf of your company, to communicate with me.

 

In addition, with reference to the above alleged account that you claim to own, I would be grateful for a signed copy of my Credit Card Agreement. Under the Consumer Credit Act 1974 (Sections 77-79), I am entitled to receive a copy of this agreement upon request.

 

I enclose a Postal Order payment of £1.00 which represents the fee payable under the said Act.

 

I understand that a copy of my Credit Card Agreement should be supplied within 12 working days.

 

I look forward to hearing from you. '

 

Hopefully you have a telephone with calling number display or a truecall device. They always call on a number starting with 01732. Unfortunately our truecall device does not work with our new telephone , (otherwise we would block them), so we just look at the caller no. If it starts with 01732, we ignore it.

 

The advice from people far better qualified than me on here is that if they don't have the CCA, they cannot do much about it but try to give you grief - don't let it get to you.

Unfortunately our truecall device does not work with our new telephone , (otherwise we would block them), so we just look at the caller no. If it starts with 01732, we ignore it.

 

Bosund, we changed from BT to TalkTalk and had a problem with the truecall not picking up calls, I emailed the customer support people of truecall and they downloaded a firmware fix to the machine which enabled it to see CLI on the talktalk line.
