National Car Parks

My wife was in Hospital late at night following the birth of our Daughter (they are all well btw)..

 

I parked in the NCP opposite he hospital at about midnight, there was no barrier and the payment machines were not lit, I was in a hurry with other things on my mind and so didn't pay to park.

 

When I got back to the car (at 3am) I had a ticket.

 

I used the punitive damages argument with NCP and they backed down. They said that when I parked in their car park I entered into a contract with them. I explained that as I was in breach of contract I could be liable for whatever costs they incurred. ie. the cost of the ticket and the lost revenue. (about £2.00) but not liable for a Penalty charge. They said I would be hearing from them to persue the funds, so I wrote a letter, and guess what! The problem has gone away. I phoned to ask about my ticket and the lady on the phone said it had been cancelled.

Before anyone asks, this probably wouildn't work with parking tickets issued by traffic wardens.

 

However, now that I think about it, I wonder whether this would work where NCP ran a car park on behalf of the Council?

This is all worth looking into - and is something that we might turn our attention to in the not too far away future
