Vint, good work so far. Has the case been stayed - didn't see any post from you saying it had. Why not go for a strike out? Is it funding (won't you get that back as costs) or is it that they have supplied enough evidence to avoid a strike out?

Thought as much, they seem a totally inept bunch. Wonder what % of their cases they win through the debtor not defending as opposed to those contested?

Seeing as you were in front of me in the telephone queue - what was your update ;) as it seemed to move pretty fast towards the end!

Halifax Card (OH) -2.9% reinstated - Sucess!

Santander/House of Fraser (1) PPI Refund plus 8% plus LOC

Santander/House of Fraser (2) PPI Refunded plus 8% plus LOC

Penalty Charge Notice - Representation accepted and PN cancelled - £120

Seeing as you were in front of me in the telephone queue - what was your update ;) as it seemed to move pretty fast towards the end!

Not realy, nothing in as yet from the other side. They did confirm that they do not pass on any ammended defences to the other side.

hi vint

i just wanted some advice in one of my other cases i'm gonna go for a strike out as 'THE BAR HAS COME DOWN' they haven't replied to my defence i've filled in the n244 and i phoned the court to find out about the fee apparently there are two fees £75.00 for A HEARING or £40.00 for no hearing any ideas ?

There is no need for a hearing. Pay £40 and ask the judge to decide.

 

Not sure what is happening over at Optima. It has been reported on another thread that MBNA are not using them again, but that was only a phone call.

i can understand why MBNA aren't using them again they're very sloppy if my case is anything to go by, they are used to just walking into court getting a SJ with no show from the defence. i've got a court date for my MBNA case i'll report more after it, how's yours?

I noticed that Eversheds lost a case this week for unfair dismissal brought by one of their own ex-employees. Draw your own conclusions.

A commonly held view I think around these parts!

 

Absolutely fair comment.

The problem is that many of these so called law firms are generally just button pushers.

 

It seems that the whole of management in most industies now, is reduced to a formula that removes the need to think. Management by numbers.
