      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi, my mam got BAYV a while back and in the last year financial probems mad he get the contract changed so all arrears we add to the end and it was over a longer period at a lower price, now at this lower price this time it was £50 short and the demand it today, but she dosent have it.

 

anyway i remember something about if you are in arrears they take something(last thing= fridgefreezer) and now she is panicing, can you give me some advice please?

i thought they could put the arrears on the end of the agreement, anyway the reason for not having enough in is because we couldnt watch the tv for 4 weeks when workmen were knoking our walls down, so we couldnt sit in a building site with a tv could we? by the way the tv was paid for 2 years ago nearly

I had my collector round for the second time this week to collect 30quid arrears but things have taken a nasty turn as i didnt have the money to pay him. On monday he took 14 quid and today he took another 15 so i make that £29 yes? i offered him another £1 to pay off arrears then carry on as normal but having only 6 weeks instead of 8 untill next payment due, anyway he point blank refused so he was asked to leave. it got me thinking so i have checked my agreements and nothing he has told me has been true. he said my payments are £126 every 8 weeks but after reading my C.A. i now know that he has been taking an extra 13 pounds every 8 weeks i know this doesnt sound alot but for someone like me it can mean an extra bit of shopping or a treat for my son. i have written a letter to them explaining as best i can my concerns, and have told them that i will report the collector to the police for theft or fraud or whatever because it isn`t right. you pay an extortionate amount for your goods only to be robbed at the same time.

i have also noticed i am paying for electronic insurance which i knew nothing about so i have also written demending it to be cancelled and my payments refunded.

these people need to be properly investigated by the FSA FOS and evry other financial body there is:-x

BAYV seem very keen to resolve any issues anyone on the forum has, I would probably advise using the above contact details to contact the customer services director and see what she says

I have been messed around now for 13 months with bayv i have had 3 sanyo tvs that have all gone down with vaious faults so i ended up with a dawoo tv from them when it arrived the cosmetic condition of the set was absolutelly shocking i phoned and they said they will send me out a new tv of the same brand etc i left my daughter who was 18 at the time in to wait for delivery as i was at hospital with baby girl...when i got in i found they had once again saddled me with yet another sanyo set when i phoned to complain they refused to exchange the set and replace it with the tv i bought ....now 5 months ago it broke down yet again same faults as the prevoius ones i have been waiting for a repair man since well 4 weeks ago they finally arrived to take away the set for repair...it was away for 2 weeks on return there was a hole in the left speaker casing a deep scratch on the screen and to top it off the faults on the tv was actually worse than ever before.so once again i complain they come take a look take it away leave me a coutesy set (with a huge hole in the side of it) another call they come take that tv away on monday gone leaving me with no tv at all and to top it off they are saying they havent got a replacement trv for me to replace mine at this moment in time.Over all this has been going on for 13 months now last christmas my kids were stuck watching a portable tv and this year we are left with no tv...shocking

Now i phoned and told them if this is not sorted by midweek this week i am going to smash open the meter and take out the £250 that is in the meter and go buy one i goit the whole you cant do that speach i said hard life take me to court i am going to remove the money today as i am so sick of waiting for a tv and managers to call me that never happens.

My question is this ...what exactly can they do if i refuse payment and hand their meter back to them?

yes just experienced both sides of buy as you view over the last 6 months . the side that dont give a toss and hope we go away we did not . then the side that could not do enough for us .my incident was highlighted on here washer catches fire and burns kitchen.1st july 2009.washer 18mths old burst into flames .the horror had only just begun. washer company investigated viewed kitchen . bauv visited my home investigated the fire.told they would get back to me never did . complained and complained but no intrest at all. by the way the washer had a fault in it ,manufacturer confirmed.we gave them a time limit in november 2009. get this sorted if not we had solicitors and barristers awaiting this case .out of the blue a phone call from m d of b a u v .long chat was had and said it will be sorted ,thought another load of bull. next day a lady rang me from b a u v kathryne director ,she said in a strong welsh voice i will not stop until this matter is concluded to your satisfaction she said trust me .she rang me daily to update me .she wanted the kitchen sorted out by christmas i thought not a chance . but she did 23/12/2009/kitchen gutted refitted and done cost £8,000 plus.whatever stood in her way she removed .her honesty decencey her respect towards us .she even had a site visit .so there you go perhaps b a u v have a lot to learn from this woman yes need to put house in order need to take customer complaints serious agree they dont ???.remember b a u v your customers are your bread and butter .without them u would have no job .if u need kathrynes e mail address . without this lady i would have got nowhere,...................

Thats exellent news so glad your sorted at long last well they were given a time limit for a manager to contact me in regards to our tv no-one contacted us so yes i have opened the meter and removed all money and bought a new tv without damaging their meter now today they finally phoned regarding payment for the first time since they took our tv they werer told today what i told them back then im not paying for a tv i dont own and i will not pay for this until im satisfied that i have a new tv to the specifications i bough not what they dumped me with so they decided to try to threaten me with so called collectors entering my home to remove goods...what goods they have it already??? i have now told them in the harshest of manners ill see you in court and dont dare even to try and enter my home i honestly do not know who they think they are if this lady helped you solve your issues as well as she has it wont hurt to contact her so if you dont mind could you pm me her email adress id apreciate it thanks

I still work for this company and you are right they are rip off merchants! You are complaining about interest charges and bad service - there is more!! How many of you have been mis sold warranty and insurance? Was it all properly explained to you?? I doubt it because when we are selling it we dont really know how to explain it ourselves!! Lots of customers who are sold the insurance already have insurance!! They are making a fortune out of it because nearly everybody is mis led into having it. We cant do anything about it because if we dont sell it we get a bo**ocking and are threatened with our job. If you try to stand up to them here or dont do as you are told you are in big trouble - some have and they are just sacked. If the insurance or warranty or interest or anything else wasnt explained to you properly write to the bosses, not Customer Service. Tell them you want to send all the goods back and you want all the money that you have paid given back because you have been mis sold products and services. Write to Graham Clarke, Chief Executive, Buy As You View Ltd, Kingsway Buildings,Kingsway, Bridgend Industrial Estate, Bridgend, CF31 3RY who by the way also used to be one of the top bosses at Brighthouse!! If he doesnt sort the problem out for you write to Adrian Hill, Chairman, at the same address or why not write to them both at the same time!! The other thing which most people seem to be ignoring is - have you noticed how we are all having the fact that interest charges are at an all time low rate? BAYV havent reduced theirs!! In fact I think they have gone up during the last couple of years!! The bosses also told us the company is now owned by the banks which makes it worse!!There is a lot more going on here which people should know about so I will come back shortly with some more. In the meantime keep me informed about how you have got on with your complaints and whether my advice has helped - good luck!!

everything i say about b a y v is honest factual and can be substantiated.a company i will never ever deal with or recomend any customer to . to leave a young family in this state for 6mths show very little intrest in the situation ,also all the other complaints on this site with regard this company.not really glowing references at all dramatic failures i would say.

i did work for this company, and believe me, they are anything but honest and upfornt with thier customers, most of the contracts are unenforceable due to bieng hand written by so called account managers, but dont worry guys, they didnt just stuff the customers they even stuff thier own staff, i was charged monthly for private fuel on the fuel card even tho i had my own car, when i asked about it they said because i was field based i had to pay for the fuel used to go to thier offices mmmm i quit shortly after, should any1 need any advice then if i can help at all i will.

Oh my god I have just filled in an application form with bayv as I need a new cooker desperately but can't get credit and can't afford to buy one. what should I do now then? I obviously don't want to be ripped off I'm only just getting by as a single mum on maternity pay but my cooker is broken. Cheers

My advice would be to cancel your application,and possible borrow money from a relative to buy cheap cooker until you can afford, other wise you will pay way over the odds for your cooker with BAYV if you ever pay it off.

perhaps that is why we have so many people trawling this site for b a y v because ex employers are coming here exsposing the company

the way it conducts buisness agreements .if your going to exspose them do it as long as it is honest.there seem to be a lot of complaints about b a y v they want to adopt the brighthouse method talking to a rep on line .keep on at them your the customer your vital to there exsitence .....

hello everyone im mandy a sinlge mum to 3 boys .....i am also experiencing problems with bayv....i have been a customer for about 5/6 yrs never ha d a problem untill last year when i purchased a table and chairs...i had only had it for less than 24hrs when the table top split so i contacted them and sent it back ..i recieved a new one which i had for a few weeks and again it was faulty this happened two more times so eventualy i had enough and sent it back for last time and requested my account be adjusted accordingly ...this is where the problems started ...my agent refered it to area manager who agreed to to take the table and chairs off the account and readjust my balance accordingly ......the rep then came and sorted out my overall balance which he stated would be 1224 that was it .i signed my paperwork and off he went ...i took a closer look and he had added another 600 interest on my account making it 1884.....few days later someone from the audit offices for bayv called asked if i ws happy and i explaind the sitution....she agreed that my account was wrong as before i purchased the table my balance was only 1640 and taking into account the payments i ahd made over the time i had the faulty product i shoulnt have been left with a higher balance than previous to table and chairs ..... anywya i called bayv and complained tehy just keep sayin they looking into it .....my agent should ahve called three weeks ago for colection he didnt show ...managed to get hold of him and he said reason he hadnt called was because my account was 1000 in credit !!! the week before this i had recieved a statement from bayv sayin that mt account balance was over 2000!!!! and that i owed 265 on my account ...i havent missed any payments !!no one i sorting out this problem and i am now at the end of my teather any suggestions would be much appreciated thank you mandy x

:-x oh and according to my statments i ahve two accounts ...only ever had one !!!

Sorry i dont know what to suggest as i find it really hard to understand my agreements and my statements but i think the other account is the maintance/warranty they put it as separate accounts which i personally think is how they make so much profit.x
