Hi All

 

Has anyone sent the seven day letter off to abbey and got thier staements within that period,and I take it the 7 day letter is just to be docterd by ourselfs to send?

 

Any one point me to a good thread on the credid card companies,whats the story with claiming back from them are all thier charges ilegal too???????????????

Mike, credit cards was the main investigation that the oFT have already reported on so their charges are particularly reclaimable. Just use the same approach and modify the template letters as needed for the card your reclaiming from.

I have the first letter ready to post to abbey for my statements, but am now pooping myself when I see how abbey seem to be happy to go to court!!!

does anyone have any positive news about them?

Send your SAR and try and understand Abbey along with every other bank are not happy to go to court. So far none of them have actually appeared at a court, bit they do like to push us and our claims as far as they can in the hope we will forget it.

 

I don't doubt that one of them will eventually try and argue the case in front of a judge but don't worry as the support on this site is superb. Besdies which and before Karnevil or Glenn get in I will be the one they pick on :lol:

Hi

 

I recently had the microfiche response from Abbey when I requested the information for the last six years. I paid my £10 but as yet I have not received anything even though my 40 days are up on Monday. I spoke to them this morning only to be told that the microfiche information can take anything up to six weeks to retrieve but I will receive it eventually. The chap I spoke to was very sympathetic to my situation, when I told him that I discovered in October that for one month I had paid over £550 in charges which had prompted me to ask for the information. As a result of of my first letter to them my overdraft limit had coincidentally been dropped. So now in the last week I have received 9 cancelled direct debit payments all of which have been charged £35. He went on to advise me to cancel all my direct debits and then to speak to their debt management department.

 

I have spoken to them about a debt management solution but am not happy with the overall attitude and simply says from them that the charges will be applied and that is the end of that...even though the level of charges are perpetuating a bad situation.

 

I am so furious with the attitude:mad: . I have usefully spent the last four hours this morning going through some of the posts, docs etc. and have found great information.

 

Any suggestions as to my next action?

First Jade start a thread of your own to make it easier to keep track of your story. Then read all the FAQ's and as many threads as possible just so you get a clear picture in your mind of the process we follow.

 

I think you should get another bank account and move all your day to day banking into it as soon as possible. That will ease the pressure a little bit and give you time to start the process of getting those charges back.

Hey!! Don't worry - you will get the hang of this place if you take it easy and not panic/worry - there isn't a getting it right or wrong here - we can all lose track of where we posted etc.. (it's my party trick!!)

 

Another way you can see where you recently posted is to click onto your name on one of your posts (the MFaulkener in the top left hand side of the message box) you'll see a grey drop down box appear with some headings in there ? One of them will say view recent posts - if you click where it says view recent posts - your list of posts will appear? (try it a couple of times as sometimes if you move mouse too quickly the grey box of stuff disappears before you had chance to read it ha ha - but try it again till you get the bit you want to click into)

 

When you see your list of posts - you should be able to click to the post you want to go to - it seems all your 7 posts are in two threads (this one and the one you think you've lost) - I just looked and your other posts are there still - so you should be able to go see what you asked etc..

 

It will take you time to get familiar on here but keep going you'll find clicking on a posters name also allows you to send the poster a personal message (that will go personally to them if you say want privacy in a topic you don't want to discusss/post on the board etc..) - you can also see where the person posted recently as well.

 

I hope from this you will find what you were looking for etc.. try spend some time just getting used to the different screens - don't give up here - there is such a lot of useful information here to help you etc.. it's a shame you'd miss out!!

 

Post again if you get stuck I will try explain this stuff to you - I don't know lots - but I might just be able to explain the screens to you - it's easy to lose track where you been posting and where you have been reading etc..

 

You can also click on search and enter you own user name and it will list all threads you have posted in :D

The site is fairly intuitive if you pause for a moment and think about what your trying to do and where you want to go.

Only joking, i think this site is pretty imtimidating bearing in mind the reason most people are here for and how important it is to them to be able to reclaim these charges.

 

But the others are right, dont panic jsut take your time start threads in the relevant forums to post your own information and away you go.

Ok I find it fairly intuitive but that could be because I am a member of several forum sites that use the same software. Plus being professionally qualified in IT helps. I do find searching for something specific can be long winded though.

Its true that if you're used to forums then its not a problem, like you i also use other forums and they use this or similar software.

 

Something occurred to me though is that many of the people coming onto this site are not experienced PC or forum users from some of the questions asked.

 

For them I think its intimidating, partly because of the number of posts and the content.

 

Having said that though, there is a huge amount of goodwill on this site and the amount of help from other users is pretty good to say the least.

 

I have to say not all forums are like this.

Hi I Sent Off To Abbey For My Microfiche Files And Have Also Sent Them A Letter Saying That They Now Have 14 Days In Which To Refund All My Charges Or I Will Be Starting Legal Proceedings. What Happens Now. Did I Need To Send Them A Total Of All My Charges Or Do I Just Make Them Aware That I Know The Full Charges Over The Last 6yrs And They Now Have To Refund Them?

 

First Jan have you started your own thread as that make sit a lot easier for us to keep up with your particular case and give better advice. Your prelim letter should ideally have included a schedule of charges you are reclaiming.

Well it looks like the abbey are using new tactics.

 

Sent my DSAR request about a month ago, with enclosed cheque and Two utility bills (originals and not copies) at my new address as proof of ID, sent by first class signed for, which they received on the 21/10/06.

 

Received this letter today from Pam Speed:

 

 

Dear Mr xxxxxxxxxxxxxx

 

Thanks for your recent request for copy statments.

 

I note that the address on your letter differs from that registered on your account.

 

As your account is closed and we are unable to change your details on our computer systems we require proof of identity in order to supply any transactional information in relation to the above account.

 

Therefore please find enclosed your £10 fee as we were unable to process your request.

 

Ok, so

 

1) what the hell were the councill tax bill and the water bill enclosed , if not proof of ID. "By the way I have a wittness that these 2 items were enclosed before the envelope was sealed up"

 

2) Why Have they not contacted me earlier requesting these documents if they were not, present with the letter.

 

I think the next step is a letter of complaint to the Information commisioner.

 

I just had a very similar letter from Egg. The 40 days have expired and I get a letter saying that as they haven't recieved a reply to their letter asking for ID here is the cheque back.

 

The address on my letter is the same as on the account and my signature hasn't changed so that should be sufficient. I sent a letter enclosing the cheque back to them and telling them they have an extra 7 days before I report them to the ICO.

I didnt have any problem getting the information from Abbey even though it was on mocrofishe, my problem is getting them to admit they are at fault. They kindly offered to send me the relevent information without taking my £10 as an act of "customer service". They have written to me offering me £700 of the £3000 I asked for as a "goodwill jesture" and stated that there charges are completley lawful, (enclosing a leaflet) so what now??

 

Firtsly melochange it will be easier to help you if you start your own specific thread in the Abbey forum.

 

I assume their offer was in reply to your prelim letter, if so you can either decline it and send the LBA letter or accept it as a partial payment and reserve the right to continue your claim for the balance and still send the LBA. They are never going to admit they are at fault. if you have already sent the LBA then write a letter to them either accepting it as part payment or declining it then procede to moneyclaim in your time frame.

Worthingmum, I cant emphasis enough what TANZARELLI has said. Please spend some time reading the FAQ's and some threads in the forum of interest. This will give you an understanding of the process for reclaiming the charges and also give you a good insight into how others are managing. Spend a few days if possible doing this then start a thread of your own in the relevent forum. This will make targeting advise to you a lot easier and more specific. :D
