      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

sis has now received a " offer of settlement " without prejudice

 

from barker & lowe

 

a one off offer of 75% off:rolleyes:

 

instead of £531....which should actually be £217

 

she can pay £398 if payed within 48 hours and payment can be made by debit or credit card.

 

they will also except instalments if this amount can not be raised,but with no reduction.

 

then goes on to say you must pay within 14 days of the date of this letter,remember late payment costs more,talk to us we can help.

liked the ending

 

"our job is to help you deal with this problem,or in the event that you fail to deal with this SERIOUS MATTER,to ensure that this debt is recovered by taking LEGAL ACTION against you OR to collect it by any other lawfull means."

 

toss up between I do not acknowledge or cca request.

no responce from barker & lowe to "prove it"

 

todays letter

 

balance now £597

 

their client wonga have instucted them to collect

payment in full must be made within in 4 days of the letter,dated 29th.

so out of time then:rolleyes:

a doorstep collector will be instructed to call and under the terms of your contract YOU will be liable for the extra costs incured.

 

shame that she will miss them,as she is off to malta tonight for a fortnight.

wonder if she will be charged extra for a wasted journey all the way from london.

 

atempted to ring and tell them not to bother, strangly enough they said good morning wonga:rolleyes:not barker and lowe.

maybe I dialed 9 instead of 10 at the end of the almost identical number and got wonga customer care.

 

cca request send.

no responce received from wonga for cca request or failure to template.

 

letter received today from

grosvenor legal services..baliffs

and the word bailiffs clearley visable for all to see through the clear address panel:mad:

instructed by wonga to recover the debt...now £605

 

payment within 7 days of the letter date, or they will commence immediate legal action.

the judgement obtained will be supplied to credit referencing organisations.

 

letter dated 12th...so out of time then last friday:rolleyes:

 

 

are they bailiffs or debt collectors

anyone had dealing with them?

Nope, unless there is a CCJ against the amount they are common DEBT COLLECTORS and can be told to get lost. Just because they are a bailiff firm doesn't mean to say they can go into doorstep debt collecting.

 

Report the letter to Trading Standards and ask for it to go to the Money Laundering Unit of the local police force, for that is what Wonga are about.

 

They really need to be closed down, not only do they have a dreadful name they have people with little regard for the law.

 

Keep the emails as they prove you have tried to negotiate and got automated responses back - could come in handy in the future.

have told her to keep all e-mails 24 in total

and copies of all letters sent and recieved.

 

 

have called local ts and someone is going to call out to see her tomorrow.

interested in

 

a.the word bailiffs is showing on the address panel

b.payment can be made by credit card

 

and the line which says

we have been instructed by wonga to recover the sum of xxxx for which you are indebted to in relation to personal loan and now DEMAND payment.

Hello, what is going on with this? I have £947 due to wonga on the 14th April - that i plan to default on (along with other payday loan) im going to guess that this will go up to around £1200 beofre i get any sort of reply from them. Would like to know what to expect, and how lond it will take to pass to a DCA

Just been looking about Wonga need to get to grips with them as I have paid most of a loan off from last month but still own £180 as intrested is being added I notice your name in these chats I was wondering Do you have the bank details for wonga so I can start a standing order up to them ? and a e-mail to send a e-mail to them to let them know what I intent to do ?

How did you get that far with them I can not get an answer did you just send a e-mail ? if so which e-mail ? and did you just tell them that you were going to pay back by standing order also did they have your bank details ?

I defaulted on a loan with Wonga. It has now been passed to JBDR who claim that letters were sent out to me on the 8th January, and 7th February to which I had never receieved. Yet searching through my emails, I had one from Barker and Lowe, on the 7th January, giving me until the 14th January to pay all the money.

Made a telephone call to JBDR on the 6th April after receiving a voicemail asking me to contact them.

I said I had not received any written notification of yourselves or Wonga to actually say you are legally entitled to collect this debt, and I wish to try and set up a payment arrangement..... was told we will send everything to you via email to which I have still not received.

Received another voicemail this morning, asking me to contact them again, explained everything to the person I was speaking to, said another email will be sent out........ STILL WAITING!!!

I don't know what to do :(

no not really any further forward, she did sent the account is in dispute/bemused letter to grosvenor on 24th march.suggesting that it was returned to wonga who have failed to supply the cca as requested.

 

heard nothing back as yet:eek:

and passed to barker and lowe

 

barker and lowe choose to ignore bemused letter and didnot return to wonga to remedy the breach but passed on to grosvenor.

 

grosvenor recieved bemused letter in march and all went quite.

 

todays post a letter from 1st cred:D:D

:pnot at all worried,a full and final offer of the original amount only will be offered or they can take it to court.... only paying just as soon as someone,anyone produces cca:D

 

 

will wait and see if they write again and then AGAIN tell them to return to wonga.

 

going to put another complaint in tomorrow as this is now the 2nd time it as been passed on while in dispute,not counting wonga's pets barker and lowe.

saving everything just in case we get a nice day out in court.
